| المستخلص: | يهدف البحث إلى إبراز أهمية معرفة أساليب الاستنباط الخبرية الدالة على الوجوب، وبيان أثرها بذكر أمثلة لكل أسلوب من هذه الأساليب. ويتكون البحث من مقدمة، وأربعة مباحث، وخاتمة. المقدمة: وتشتمل على موضوع البحث، وأهميته، وهدفه، والدراسات السابقة، ومنهجه، وإجراءاته، وخطته. منهج البحث: المنهج الاستقرائي الذي يقوم على تتبع وحصر الأساليب الخبرية الدالة على الوجوب. والمنهج التطبيقي الذي يقوم على معرفة كيفية استخدام الأساليب الخبرية في استخراج الأحكام التكليفية، عن طريق ذكر أمثلة للأساليب. أهم نتائج البحث: بيان الأساليب والصيغ الخبرية الدالة على الوجوب، فهي تعين المجتهد على استخراج واستنباط الأحكام التكليفية من الأدلة الشرعية. ومن هذه الأساليب الدالة على الوجوب: ما ورد بصيغة الخبر ويراد به الأمر، وما ورد بألفاظ مصرحة بمعنى الوجوب، مثل: الأفعال التالية: (كتب)، أو (فرض)، أو (وجب)، أو (قضى)، وما ورد بلفظ (الحق)، والتعبير عن الوجوب بلفظ (على)، وما ورد بلفظ الوصية، التعبير عن العبادة بجزء منها، وترتب الوعيد على ترك الفعل، وذكر الفعل جزاء لشرط. The research aims to highlight the importance of knowing the methods of deductive deduction indicating that it is obligatory, and to show its impact by mentioning examples of each of these methods. Introduction: It includes the subject of the research, its importance, its objective, previous studies, its method, procedures, and plan. Research Methodology: The inductive method, which is based on tracking and limiting the informative methods indicating the necessity. And the applied approach, which is based on knowing how to use informative methods in extracting mandated judgments, by mentioning examples of the methods. The most important results of the research: A statement of the methods and news formulas indicating the obligation, as they help the mujtahid to extract and derive the mandated rulings from the legal evidence. Among these methods indicating the obligation: what is stated in the form of the news and is intended to be the command, and what is stated in explicit words meaning obligatory, such as: the following verbs: (books), (imposes), (must), or (decides), and what is stated with the word (The right), and expressing the obligation by the word (on), and what was mentioned in the wording of the will, the expression of worship in part, and the threat to abandon the act, and mentioning the act as a penalty for a condition. |
