| 520 | |f The medical certificate proves facts of a medical nature, and therefore it must be written objectively and with full integrity since the legal responsibility of the doctor rests in the case of writing a certificate that violates the truth. The law requires that the medical certificate be issued and signed by the doctor after an actual examination of the patient, as he has to mention the date and time of the examination, in addition to the identity of the patient, and shall be handed over to the patient personally.\nThe Penal Code criminalizes forgery that a doctor may commit when writing medical certificates as a courtesy, and the Prevention and Control of Corruption Act also suppress the bribe-taking by doctors. The Code of Medical Ethics prohibits the doctor from writing medical certificates as a courtesy and granting the patient unjustified benefits.\nThis abstract translated by Dar AlMandumah Inc 2018. | ||
| 520 | |d Le certificat médical est un acte destiné à constater des faits d'ordre médical, et doit être parfaitement objectif et honnête. La responsabilité juridique du médecin est engagée en cas de fraude ou de déclaration mensongère. La rédaction d'un certificat ne peut se faire qu'après un examen effectif du malade. Un certificat médical doit être rédigé par un médecin et comporter, sa signature, la date, du jour où il a été établi l'heure de l'examen, l'identité du demandeur, et doit être lui remis en main propre. \nLa loi pénale réprime le faux commis par le médecin en cas d'établissement des certificats médicaux de complaisance. La loi relative à la prévention et la lutte contre la corruption réprime l'établissement des faux certificats par les médecins poursuivis pour délit de corruption, de même le code de déontologie médicale interdit la délivrance des certificats de complaisance , ainsi que tout acte de nature à procurer au malade un avantage matériel injustifié. | ||
| 520 | |a تثبت الشهادة الطبية وقائع ذات طابع طبي، ولهذا يجب أن تحرر بموضوعية وبنزاهة تامة حيث أن المسؤولية القانونية للطبيب تقوم في حالة تحرير شهادة مخالفة للحقيقة، ويشترط القانون بأن تحرر وتوقع الشهادة الطبية من الطبيب بعد معاينة فعلية للمريض، حيث يدون عليها تاريخ يوم وساعة الفحص وهوية المريض، ويجب أن تسلم لهذا المريض شخصيا.\nيجرم قانون العقوبات التزوير الذي قد يرتكبه الطبيب، عند تحريره لشهادات طبية على سبيل المجاملة، كما يقمع قانون الوقاية من الفساد ومكافحته ارتكاب جنحة الرشوة من قبل الأطباء، وأن مدونة أخلاقيات الطب تحظر علي الطبيب تحرير شهادات طبية على سبيل المجاملة، ومنح المريض مزايا غير مبررة. | ||
