| 520 | |a هذا البحث يتكلم عن التعليل بالضرورة في مسائل الأمر، والتعليل بها منهج سلكه الأصوليون عامة؛ ولذا ترجح أن الضرورة المعلل بها هي: الفعل الذي لا يمكن التخلص منه، وهي حجة عند الجميع إذا سلمت؛ ولذا نفى الغزالي النزاع فيها، وقد علل بها الأصوليون في مسائل متعددة من مسائل الأمر سلم منها: التعليل بها على دلالة الأمر المطلق على الوجوب، وأن الأمر إذا صرف عن الوجوب يكون مجازا، وأن الأمر بالمركب أمر بأجزائه، وأن الأمر بالشيء أمر بما لا يتم إلا به، وأن الأمر بالشيء نهي عن جميع أضداده، وأن النهي عن الشيء أمر بأحد أضداده. ولم يسلم التعليل بها: على نفي صيغة الأمر، وكذا لم يسلم القول بكراهة الضد، ولو كان الأمر للإيجاب، ولم يسلم التعليل بها على أن الأمر المطلق لا يدل على مرة ولا تكرار بذاته، ولا على أن النهي يدل على الأمر بأحد أضداده ندباً. | ||
| 520 | |b This research is concerned with the study of necessity-based cause-effect relationship with respect to command issues. It seeks to define necessity, particularly from the fundamentalists’ point of view across their causal explanations. It also attempts to identify and study command issues based on causal necessity. The research follows an inductivity approach. The research concludes with thirteen findings about the definitions of cause-effect relationship and of necessity, about the use of causal necessity by various creeds, and about the particular concern with commands’ various formats and implications for application and for prohibitions vs commands. The research recommends that further extensive studies be conducted on Fiqhi foundation issues from the perspective of necessity-based causes. The issues could be surveyed, identified and academically investigated, and so could their Fiqhi branches. The research also recommends that Fiqhi events be studied in relation to appropriate fundamental rules. Since necessity is used to justify particular command legislations, the need arises for competent investigation to establish genuine necessities as causes. | ||
