| المستخلص: | يعتبر حق بقاء الشريك في الشركة من أهم الحقوق التي حماها المشرع، خاصة في شركات الأشخاص كون أن الاعتبار الشخصي يلعب فيها دورا كبيرا في استقرار واستمرارية الشركة، وأي مساس به يؤدي إلى زعزعزتها مما يؤثر على مجمل الحياة الاقتصادية، إلا أن المشرع وضع استثناءا وتراجع عن الاعتبار الشخصي وأقر مبدأ فصل الشريك، وأحاطه بمجموعة من الأحكام والشروط مبينة كلها على أساس الحفاظ على الشركة وحماية المصلحة الجماعية للشركاء. The right to remain a partner in the company is one of the most important rights protected by the legislator, because personal consideration plays a major role in the stability and continuity of the company especially in the partnerships .and any prejudice that leads to its destabilization ,which affects the overall economic aspects, therefore the legislator put an exception and declined the personal consideration and approved the principle of separation of the partner ,and surrounded by a set of terms and conditions are all set on the basis of maintaining the company and protect the collective interest of partners. |
