| المستخلص: | يتناول هذا البحث بالدراسة مبدأ الاعتبار الشخصي للمكلف، الذي يجعل لكل فرد كيانا خاصا لا تطغى عليه الجماعية ولا ضرورة التبعية، إلا حيث تكون ضرورة، فلكل فرد شخصيته المستقلة، ونيته الخاصة به، وهذا المبدأ له أثر واضح في كثير من الأحكام الفقهية، ويتناول هذ البحث التأصيل الفقهي لهذ المبدأ وبيان القواعد الفقهية المرتبطة به، وعنونت له بعنوان "مبدأ الاعتبار الشخصي تأصيلا وتقعيدا" وقد جاء البحث في مقدمة ومبحثين وخاتمة: أما المقدمة فقد تضمنت أسباب اختيار الموضوع وأهميته والمنهجية العلمية المتبعة في البحث. وتضمن المبحث الأول مفهوم الاعتبار الشخصي والتأصيل الفقهي له، وجاء في مطلبين؛ المطلب الأول في تحديد مفاهيم البحث والتعريف به في اللغة والاصطلاح والقانون، والتمييز بين الاعتبار الشخصي والشخصية الاعتبارية، وأما المطلب الثاني ففي التأصيل الفقهي لهذا المبدأ. وتناول المبحث الثاني التقعيد الفقهي لهذا المبدأ، وبيان بعض القواعد والضوابط الفقهية المرتبطة به، ثم الخاتمة: وفيها أهم نتائج البحث؛ ثم قمت بفهرسة المصادر والمراجع فهرسة هجائية. This research deals with the principle of personal consideration, which entails that each person has his private entity, his independent personality and his own intent. It examines the jurisprudential rooting of this principle and explains the jurisdictional rules associated with it. It is titled: ‘The Principle of Personal Consideration: Setting the Basis and the Rules’. The introduction includes the reasons for choosing the topic and the importance of the research. The first part examines the concept of the principle of personal consideration and its jurisprudential rooting. It is divided into two subsections: the first subsection defines the research concepts in terms of language, convention and law, in addition to explaining the distinction between personal consideration and legal personality. The second subsection explores the jurisprudential authentication of this principle. The second part deals with the jurisprudential setting of the rules for this principle and clarifies some of other rules related to it. As for the conclusion, it includes the most important results. |
