| 520 | |a تلعب آلية تحول العقد، دوراً كبيراً في انقاذ العقود من البطلان بما يضمن المحافظة على استقرار العلاقات التعاقدية، وضمان مصالح المتعاقدين. ونظراً لهذه الأهمية أخذت هذه النظرية طريقها إلى القوانين العربية والغربية وأن اختلفت في شكل تبنيها، بين من نص عليها كقاعدة عامة وهو نهج المشرع الجزائري في المادة 105 من القانون المدني، وبين من نص على بعض التطبيقات أو صور لتحول العقد مثل القانون الفرنسي والقانون الإنجليزي. أن الاهتمام الذي خصه المشرع الجزائري لآلية تحول العقد بالنص عليها كقاعدة عامة إضافة إلى جملة النصوص الخاصة، جاء ضمن شروط قانونية يلتزم القاضي بالبحث عنها ويشكل شرط ضرورة البحث عن إرادة أطراف العقد، السمة المميزة لنظرية تحول العقد في القانون المدني الجزائري عند تطبيقها من طرف القاضي. | ||
