| المستخلص: | Turning mechanism of the Decade, play a significant role in the rescue of the invalidity of contracts to ensure the preservation of the stability of contractual relations, and ensure the interests of the contractors. The attention which the Algerian legislature turning mechanism of the Decade by, inter alia, as a general rule, in addition to the texts of the legal conditions, came within the judge is obliged to search for the requirement of the need to search for the will of the parties to the contract, the hallmark of the theory of the transformation of the decade in Algerian law when applied by the judge تلعب آلية تحول العقد، دوراً كبيراً في انقاذ العقود من البطلان بما يضمن المحافظة على استقرار العلاقات التعاقدية، وضمان مصالح المتعاقدين. ونظراً لهذه الأهمية أخذت هذه النظرية طريقها إلى القوانين العربية والغربية وأن اختلفت في شكل تبنيها، بين من نص عليها كقاعدة عامة وهو نهج المشرع الجزائري في المادة 105 من القانون المدني، وبين من نص على بعض التطبيقات أو صور لتحول العقد مثل القانون الفرنسي والقانون الإنجليزي. أن الاهتمام الذي خصه المشرع الجزائري لآلية تحول العقد بالنص عليها كقاعدة عامة إضافة إلى جملة النصوص الخاصة، جاء ضمن شروط قانونية يلتزم القاضي بالبحث عنها ويشكل شرط ضرورة البحث عن إرادة أطراف العقد، السمة المميزة لنظرية تحول العقد في القانون المدني الجزائري عند تطبيقها من طرف القاضي. |
