| 520 | |a تتحدث هذه الدراسة عن مقاصد الشريعة في حفظ المال مقارنة بما عليه العمل في النظام السعودي، حيث يهدف البحث إلى توضيح أهمية المال وأنه ضرورة من ضرورات الحياة لتحصيل مصالح الدنيا والآخرة، وبيان المقاصد الشرعية في حفظ المال الخاص التي تتجلى في حفظه وتنميته وتثميره وإنفاقه في الوجوه المعتبرة شرعًا، وتجنب جمعه من وجوه الحرام، أو حبسه وتبذيره، تجلية المقاصد الشرعية في حفظ المال العام في أنه وسيلة لتدبير المصالح الاقتصادية للدولة، إبراز ما وضعه المنظّم السعودي لحفظ المال العام والخاص من الأنظمة التي تتوافق في مجملها مع قواعد الشريعة الإسلامية، وقد استخدم الباحث المنهج الوصفي والتحليلي، كما استنتج أن التوافق في معنى المال بين النظام السعودي والفقه الإسلامي، أن الإسلام راعى الغريزة الإنسانية في حب المال، فنظمه كسبًا وإنفاقًا وحفظًا، سمو مقاصد الشريعة وتوافقها مع حاجات الناس ومصالحهم، توافق النظام السعودي مع قواعد الشريعة في تقرير المقاصد من حفظ المال، ووصى الباحث بتفعيل منهج المقاصد الشرعية في مختلف جوانب الحياة الاقتصادية؛ لما له من أثر بالغ في حماية المال، وإبراز دوره في التنمية، ومن شأن ذلك إثراء المكتبة الفقهية بمزيد من الدارسات الشرعية في إطار منهج الوسطية. |b - To explain the importance of the benefaction of wealth, and that it is a necessity represents one of the necessities of life to obtain the benefits of life and afterlife. - Explaining the legal purposes of saving the private money which manifested in its saving , development, investment and expenditure in legally considered aspects, and it avoids the obtaining of money from illegal sources or to incarcerate or to sow it. - The legal purposes of Sharia appear very clear in saving the money because it is the means for management of the economic interests of the country. - To highlight the systems which are prepared by the Saudi legislator for saving the public and private wealth that conform in general with the purposes of the Islamic Sharia Law. Method of research: the descriptive and analytical method. Most important results: - The conformity in the meaning of money between the Saudi system and Islamic jurisprudence. - Islam religion considered the humanitarian instinct in loving of money, so it organized it in all aspects in terms of obtaining, expending and saving. - The highness of the Sharia purposes and their conformity to the requirements and interests of people. - The conformity of the Saudi System to the rules and principles of the Sharia in acknowledging the purposes in saving the money. The recommendations: -The recommendation to activate the method of the sharia purposes in the different aspects of the economic life, because of its great effect in the saving of the money, and to highlight its role in the development. This will enrich the jurisprudence library with more legal studies within the framework of the moderation principle. | ||
