| المستخلص: | خلق الله البشر من ذكر وأنثى وشرع بينهما الزواج وجعله ميثاقا غليظا أساسه المودة والرحمة وضبط العلاقة بين الزوجين بضوابط العدل والفضل والتكامل في الأدوار والوظائف،ضمانا لحسن العشرة ودوام الألفة وتحقيقا لمقاصد الشريعة الإسلامية من تكوين الأسرة،وهي حفظ النفس والنسب والنسل والعرض والدين،إلا أن الحياة الزوجية المشتركة قد تتخللها كثير من مواقف المدّ والجزر تحدث خلالها خلافات زوجية؛بل إن الأزواج قد يقصرون ويخلون في كثير من الأحيان بواجباتهم لذا وزع الشرع الأدوار بينهما ورتبّ على عاتق الزوجة واجب طاعة زوجها فيما يجب له،وخوّل للزوج حق تأديبها في حال إخلالها بهذا الواجب وفقا لضوابط وحدود ووسائل معينة ومرتبة بدءا بالتأديب بالوعظ والنصح والتذكير بالحقوق التي لها والواجبات التي عليها ثم هجرها في المضجع وأخيرا تأديبها عن طريق بواسطة الضرب دون التعسف في استعمال هذا الحق. غير أن هذه الرخصة الشرعية قد تتحول إلى جريمة حينما يتجاوز الأزواج حدود الشرع والقيود المباحة،لاسيما إذا شكل التأديب صورة من صور العنف –وتحديدا العنف الزوجي-المفضي إلى العاهة أو المساس بحرمة الجسد أو الكرامة،الأمر الذي يجعلنا نقدم هذه الورقة البحثية التي سنحاول فيها تقديم رؤية فقهية قانونية معاصرة لحق الزوج في تأديب زوجته بين أسباب الإباحة والتجريم. However, these legitimate license may turn to crime when they exceed Islamic law limits and restrictions which are permissible, especially if the disciplinary form is one of the violence one like marital violence-leading to disability or compromising the sanctity of the body or dignity, which is why we offer this paper that we'll try from it to provide better jurisprudential contemporary legal right to the husband to discipline his wife, between the reasons for the permissibility and criminalization |
