| المستخلص: | تقوم الدراسة ببيان مفهوم القوامة ، والأحكام الفقهية التي تتعلق بها. وتهدف إلى: تجلية مفهوم القوامة ، والألفاظ ذات الصلة ( الألفاظ الشرعية - المصطلحات الحادثة ) ،وأدلة مشروعيتها، والحكمة منها، والآثار المترتبة عليها، ومنهج الدراسة هو: المنهج الاستقرائي التحليلي الاستنباطي المقارن ، وأهم نتائج الدراسة : أن القوامة مشروعة، وقد دل على مشروعيتها الكتاب والسنة والمعقول ، وبيان الألفاظ ذات الصلة بالقوامة الشرعية كالوصاية ، والولاية ، ونحوهما، أو المصطلحات الحادثة كالسلطة الذكورية أو الوصاية الذكورية ، وغيرها مما يراد لتشويه المعاني الصحيحة الشرعية ، وبيان الحكمة منها كتنظيم شأن الأسرة ، وتوحيد رئاستها ، ثم تفصيل ما يتعلق بآثارها التي منها ، رعاية الزوجة والقيام على شؤونها ، وإحسان عشرتها بما يشمل المعاشرة القولية والفعلية ، ووجوب طاعة الزوج في المعروف ، واستئذان الزوج في الخروج من المنزل بما لا يمس الأسرة بأذى مع مراعاة قواعد الشرع العامة في هذا الأمر بما لا يكون فيه ضرر على الزوجة ، واستئذان الزوج في إجارة نفسها للعمل ، واستئذان الزوج في إدخال الآخرين منزله فيما لا يعلم رضا الزوج ، فإن علمت رضاه به جاز إدخاله بلا إذن ، واستئذان الزوج في إرضاع ولدها من غيره ، وله المنع ما لم يضطر الصغير إليها ويخشى عليه التلف ، وتقويم الزوج سلوك زوجته إذا ما حصل منها تقصير وعصيان لأداء حقوقها الواجبة وفق التدرج المذكور في القرآن، بالبدء بالوعظ ثم الهجر ثم الضرب ، ومن أهم التوصيات : نشر الوعي والتثقيف للأسرة ، ولا سيما الزوجين ، لبيان حقوق كل منهما وتجلية المراد بالقوامة بما يكفل حسن استخدامها دون إساءة للمرأة ، وتجلية ما تتعرض له المصطلحات الشرعية بشكل عام ،والقوامة بشكل خاص، من تلاعب لتشويهها وإظهارها بصورة سيئة تنفر من التمسك بها ، وتأسيس منظمات ولجان للأسرة يكون من مهامها نشر الوعي الديني بكيفية التعامل السامي بين الزوجين ، وحل ما يطرأ من مشكلات من منطلقات شرعية ، وطرح البديل الإسلامي حال تجاوز الزوج في استخدامها. The study shows the concept of guardianship and the jurisprudence that relates to it. It aims to: clarify the concept of guardianship, the relevant terms (Islamic terms - created terminology), the evidence of its legitimacy, the wisdom thereof, and the consequences. The study method is a comparative deductive, inductive analytical approach. The most important results of the study are that guardianship is legitimate, and its legitimacy is evidenced by the Qur'aan, Sunnah and logic, and the explanation of the words related to Islamic guardianship such as (al wasaya) custodianship, (al walayah) wardshp, etc., or the created terminology, such as male authority or male guardianship. And other things that are intended to distort the correct and legitimate meanings, and to explain the wisdom of them, such as organizing the family, unifying the leadership of the family, then elaborating on what is related to its consequences. Taking care of the wife, and look after her affairs, and giving her kindness, including in both oral and actual relationship, and the obligation to obey the husband in respect of what is good, and asking the husband's permission to leave the house in a manner that does not harm the family, taking into account the general rules of sharee'ah in this matter in a manner that does not cause harm to the wife, and asking the husband's permission in leasing herself to work and the husband's permission to let others enter his house where the husband's satisfaction is not known. If you know that he is consenting to him, it is permissible to enter him without permission and husband's permission to breastfeed her child, not the other, and he has the right to prevent it unless the young child is forced to it and is afraid of harm. The husband should correct his wife's behavior if she has failed and disobedience to fulfill her due rights according to the steps mentioned in the Qur'an, starting with preaching, then abandoning, then beating. Among the most important recommendations are: to raise awareness and educate the family, especially the spouses, to explain their respective rights and to clarify what is meant by guardianship so as to ensure that it is properly used without abuse to women, and to clarify the manipulation to which sharia terminology is subject in general, and to guardianship in particular, the manipulation of distorting it and showing it in a bad way that drives away adherence to it, the establishment of family organizations and committees, one of whose tasks is to spread religious awareness of how to deal with the spouses, solve any problems arising from Islamic grounds, and put forward the Islamic alternative in case of bypassing the husband in using it.\nThis abstract translated by Dar AlMandumah Inc. 2018 |
