| المستخلص: | ينصب الاختصاص بالتشريع على التوفيق بين مصالح الفرد والمجتمع المتعارضة مبتغيا بذلك تحقيق السعادة والرفاهية للاثنين معا ما استطاع إلى ذلك سبيلا؛ فالقواعد القانونية التي تنشأ عن ممارسة هذا الاختصاص ما هي إلا وسائل وأدوات يستخدمها القائمون على إدارة شئون البلاد من أجل تحقيق أهدافهم النبيلة والسامية التي تكاد أن تصل بمن يحرص على تحقيقها بمنتهى الإخلاص والصدق إلى مراتب الأنبياء والمرسلين. ويتضمن ممارسة هذا الاختصاص المرور بمجموعة من المراحل التشريعية المتعاقبة التي يسلم كل منها التي تليها حتى نصل في نهاية الأمر إلى إنشاء قواعد قانونية قادرة على تحقيق الأهداف المنتظرة منها والآمال المعلقة عليها. إذ تتمثل أهداف المرور بجميع هذه المراحل في تنقية هذه القواعد من شوائب الأهواء والمصالح الخاصة التي قد تعلق بها نتيجة لسبب أو لآخر، وفي ممارسة التفكير الهادئ المستنير، وفي فهم هذه القواعد وفهم مقاصدها وأهدافها بعمق وروية حتى نصل في نهاية الأمر إلى الحصول على استجابات فعالة وحقيقية لما ينشأ داخل المجتمع من مؤثرات اجتماعية أو اقتصادية أو سياسية. The jurisdiction of legislation is focused on reconciling the conflicting interests of the individual and society, with the aim of achieving happiness and well-being for the two together as much as possible. The legal rules that arise from the exercise of this competence are nothing but means and tools used by those in charge of managing the affairs of the country in order to achieve their noble and lofty goals, which almost reach those who strive to achieve them with utmost sincerity and honesty to the ranks of the prophets and messengers. Exercising this jurisdiction includes going through a series of successive legislative stages, each of which recognizes the next, until we finally reach the establishment of legal rules capable of achieving the expected goals and the hopes attached to them. The objectives of going through all these stages are to purify these rules from the impurities of whims and special interests that may be attached to them as a result of one reason or another, and to practice calm and enlightened thinking, and to understand these rules and their purposes and goals deeply and deliberately until we finally reach effective and real responses What arises within the community of social, economic or political influences. |
