| المستخلص: | حيث كان التكييف الفقهي عرضة للاختلاف والتغير وفق أسباب موضوعية أوجبته وعلل ومقتضيات صحيحة أوجدته، يأتي هذا البحث ليسلط الضوء على دوال التكييف، وأسباب اختلاف وتغير التكييف الفقهي، وأثر دوال التكييف على أسباب اختلاف وتغير التكييف الفقهي؛ في محاولة لتحديد الاختلاف والتغير المقبول في التكييف الفقهي، وفي محاولة لإبراز أثر دوال التكييف في الحد من هوة الاختلاف في التكييف الفقهي من جهة، وعلى ضبط الحاجة لتغير التكييف الفقهي من جهة أخرى. وقد عرض البحث عددا من نماذج اختلاف التكييف وتغيره في التراث الإسلامي والواقع المعاصر وتناولها بالمناقشة كدراسة تطبيقية لما تم تحديده من دوال اختلاف التكييف الفقهي وتغيره. واستعمل البحث المنهج الاستقرائي والتحليلي للمراجع والمصادر ذات العلاقة لما تقتضيه طبيعة الموضوع محل البحث. وقد انتظم البحث في تمهيد وثلاثة مباحث وخاتمة تضمنت نتائج البحث وتوصياته والتي كان من أهمها: إنشاء مؤسسات فقهية خاصة يكون من مهامها: النظر في المسائل التي يستدعي الواقع تغير تكييفها بناء على ضوابط تغير التكييف، وتوفير التصورات اللازمة للواقعة محل النظر بالتعاون مع الخبراء والمؤسسات ذات الصلة بموضوع الواقعة. Whereas Islamic Jurisprudential adaptation was subject to difference and change according to objective reasons that necessitated it and causes and valid requirements that created it, this research highlights the significances of adaptation, the reasons for difference and change in Islamic Jurisprudential adaptation and the significances of adaptation impact on the reasons for difference and change in Islamic Jurisprudential adaptation; In an attempt to identify the difference and acceptable change in Islamic Jurisprudential adaptation, and in an attempt to highlight the significances of adaptation impact on reducing the gap of difference in Islamic Jurisprudential adaptation on the one hand, and on controlling the need to change the Islamic Jurisprudential adaptation on the other hand. The research presented many models of difference and change in adaptation in Islamic heritage and contemporary reality and discussed them as an applied study of what has been identified as significances of difference and change in Islamic Jurisprudential adaptation. The research used the inductive and analytical approach for references and related sources as required by the nature of the research subject matter. The research consists of an introduction, three thematic areas, and a conclusion that included the research findings and recommendations, the most important of which was: the establishment of special Islamic jurisprudence institutions whose tasks include: considering issues whose reality requires to change their adaptation based on the controls of changing the adaptation, and providing the necessary perceptions of the incident under consideration in cooperation with experts and institutions related to the subject matter of the incident. |
