| المستخلص: | جاءت هذه الدراسة بعنوان: "أحكام تعيين أعضاء هيئة التدريس والقيادات في الجامعات الحكومية والخاصة والأهلية ومدى خضوعهم للتأديب" وتبرز أهميتها في أنها توضح للسادة أعضاء هيئة التدريس بالكليات أو المعاهد - وخاصة غير القانونيين منهم - نظام التعيين في الجامعات الخاصة والأهلية، ومدى خضوعهم للتأديب الخاص في قانون تنظيم الجامعات وقوانين الجامعات الخاصة والأهلية. وتتناول الدراسة مفهوم أعضاء هيئة التدريس والقيادات الجامعية، وأحكام التعيين في الجامعات الحكومية والخاصة والأهلية حديثة النشأة. ومن الصعوبات التي واجهتنا في بحثنا قصور القوانين واللوائح عن توضيح مفهوم أعضاء هيئة التدريس والقيادات الجامعية، والذي يسهم في عرض القواعد والأحكام التي يقوم عليها نظام التأديب، وهي أن هناك تطوراً سريعًا وكبيرًا ودعوات إصلاح في مجال المسئولية، أخذت الكثير من الدول بأسبابها، وأقرتها في تشريعاتها. ترجع أهمية البحث في ظل كون عضو هيئة التدريس والقيادات الجامعية قدوةً في المجتمع، يجب تسليط الضوء على إمكانية وضع مزيد من الامتيازات والحصانات لهم، ولكونهم أيضًا العمود الفقري لعملية التعليم وبناء الدولة، وهذه الامتيازات تكون على الوظيفة التي يقوم عليها وليس لشخصه؛ حتى يضمن أداء الوظيفة بفاعلية ونزاهة، كما هو قائم عليها الآن. أيضًا بالنسبة لمعاوني أعضاء هيئة التدريس من المعيدين والمدرسين المساعدين باعتبارهم النواة المساعدة لهم. يتكون هذا البحث من مطلبين؛ الأول: ويحمل عنوان (مفهوم أعضاء هيئة التدريس والقيادات الجامعية)، وينقسم هذا المطلب إلى فرعين؛ تناول الباحث في أولهما: مفهوم أعضاء هيئة التدريس ومعاونيهم في الجامعات، ثم في ثانيهما: القيادات الجامعية. والثاني: يحمل عنوان (أحكام التعيين في الجامعات)، وينقسم هذا المطلب إلى فرعين، تناول الباحث في أولهما: التعيين في الجامعات الحكومية، ثم في ثانيهما: التعيين في الجامعات الأهلية والخاصة. This study was entitled: "Provisions for the appointment of faculty members and leaders in public, private and private universities, and the extent to which they are subject to discipline. Its importance is highlighted in that it explains to the faculty members of colleges or institutes, especially the illegal ones, the system of appointment in private and private universities and the extent to which they are subject to special discipline in the Universities Organization Law and the laws of private and private universities. The study deals with the provisions of the concept of faculty members and university leaders, and the provisions of appointment in newly established public, private and private universities. One of the difficulties that we encountered in our research is the failure of laws and regulations to clarify the concept of faculty members and university leaders, which contributes to presenting the rules and provisions on which the disciplinary system is based. The importance of the research is due to the fact that the faculty member and university leaders are role models in society. It is necessary to shed light on the possibility of setting more privileges and immunities for them, as they are also the backbone of the education and state-building process, and these privileges are based on the position on which he is based and not on his person. In order to ensure that the job is performed effectively and with integrity; As it stands now. Also for assistant faculty members, including teaching assistants and teaching assistants; as their auxiliary core.
