| 520 | |a الصناعات الناشئة هي الصناعات التي تكون في سني إنتاجها الأولى، وتعتبر حمايتها وسيلة للدولة لتجنب صناعاتها الناشئة الدخول في منافسة خاسرة قد تلغيها من أصلها، فتقوم الدولة، على خلاف الأصل، بالتدخل بالسوق التجارية منعا أو إعاقة لحركة المنتجات الأجنبية، فتقيد دخول المنتج المنافس لمنتج هذه الصناعة، وغايتها في ذلك إعطاء الوقت لهذه الصناعة لتطور من نفسها وقدراتها لتصبح قادرة على المنافسة بمفردها. وتعتبر حماية الصناعة سياسة تتبعها الدولة من خلال ربط سياستها الجمركية بالسياسة التجارية وكان ذلك وسيلة متبعة في الماضي، أما اليوم ومع اتباع مبدأ تحرير التجارة الدولية أصبحت حماية الصناعات الناشئة ميزة للدول النامية فقط واستثناء من مبدأ تحرير التجارة الدولية أقرت به الدول المتقدمة إيمانا منها بحق الدول في التنمية. هذه الميزة الممنوحة للدول النامية لا تستخدمها وفق هواها، وإنما تخضع لضوابط وإجراءات معينة ومنظمة وفقا للتشريعات الداخلية لكل دولة. وتعتبر الجمهورية العربية السورية-للأسف-من الدول النامية وقد نظمت حماية الصناعات الناشئة بموجب القانون رقم 24 لعام 2010 وسنقوم من خلال هذا البحث بدراسة أحكام وشروط حماية الصناعات الناشئة وفقا لهذا القانون. |b Emerging Industries are those in the early stages of production. Protecting these industries is the way by which the government can make them avoid a losing competition which might eliminate them categorically. Opposite to the norms, the government intervenes in the market to prevent or obstruct the movement of foreign goods by restricting the flow of the competitive products to the ones of these industries in order to give these industries the time to develop themselves and their capabilities so they can be able to compete on their own. Protecting emerging industries is considered a policy which the government follows by linking its customs and trade policies. This method was used in the past. However, today, with the execution of The principle of international trade liberalization, protecting emerging industries has become a feature of developing countries only and an exemption from the liberation of trade which has been approved by all developed countries believing in the right of developing country to achieve development. This feature given to developing countries cannot be used any time they want to rather it is governed by certain regulations and procedures organized according to the internal legislation of each country. Unfortunately, The Syrian Arab Republic, is considered a developing country. It has regulated the protection of emerging industries according to Act no. 24 in 2010. This paper aims to study the provisions and conditions of protecting emerging industries according to this act. | ||
