| 520 | |b The objective of this article and the interest of its study arise in the fact of showing the extent of the protection of commercial secrets thus provided and executed by the judge and of showing his indispensable role in this matter within the framework of the commercial arbitration, and this through two main axes, the first of which relates to the legal regime of this protection, and the second axis relating to the obstacles facing effective protection of commercial secrets. All this based on a qualitative methodology based on research and diversified documentary sources, namely, theses, master's theses, reports, articles, etc., ending with a conclusion proving the dispersion and plurality of legal rules in this area. matter, and therefore which leads to a lack of uniformity in the regulation of the protection of trade secrets.. |d L’objectif du présent article et l’intérêt de son étude se présentent dans le fait montrer l’étendue de la protection des secrets commerciaux ainsi apportée et exécutée par le juge et de montrer son indispensable rôle en la matière dans le cadre de l’arbitrage commercial, et ceci par le biais de deux grands axes, dont le premier porte sur le régime juridique de cette protection, et le deuxième axe portant sur les obstacles faisant face à une protection effective des secrets commerciaux. Tout ceci en se basant sur une méthodologie qualitative reposant sur une recherche et des sources documentaires diversifiées à savoir, les thèses, les mémoires de master, les rapports, articles etc, finissant par une conclusion prouvant la dispersion et la pluralité des règles juridiques en la matière, et donc ce qui mène à une absence d’une uniformisation de la règlementation de la protection des secrets commerciaux. | ||
