| المستخلص: | يقتضي إعمال مبدأ المساواة كأحد أهم المبادئ الدستورية، أن يتم تطبيقه بشكل عادل على كافة المستويات والمجالات، لاسيما المجال الاقتصادي باعتباره من أهم المجالات التي يجب تكريس هذا المبدأ فيها مراعاة للمصلحة العامة لتحقيق التنمية المستدامة. ويتجسد تكريس هذا المبدأ في المجال الاقتصادي بصورة أكثر وضوحا في إبرام العقود الإدارية عبر تطبيق قواعد قانونية واحدة على أصحاب المراكز المتماثلة الراغبين في التنافس في إبرامها دون أن يحول ذلك من التمييز في المعاملة لاعتبارات المصلحة العامة، حيث إن المساواة بين المتنافسين في إبرام العقود الإدارية ليست مطلقة في ظل ما تفرضه التشريعات الدولية والإقليمية من قيود على مبدأ المساواة بما يهدف إلى تحقيق المصلحة العامة. إلا أن الواقع العملي يؤكد أن مبدأ المساواة في هذا المجال قد تعرض لانتهاكات فادحة تحول دون تطبيقه على الوجه الأمثل نتيجة ممارسات تواطؤيه أضحت معه عملية إبرام العقود الإدارية مجالا خصبا لانتهاك هذا المبدأ والخروج على أحكامه. لذلك كان يتعين على الدول الراغبة في تحقيق التنمية المستدامة التحول نحو الاستغلال الأمثل للبيئة الرقمية؛ لما توفره من تكريس لمبدأ المساواة في عملية إبرام العقود الإدارية نتيجة عدم التعامل المباشر بين المتنافسين للتعاقد مع الإدارة وبين موظفيها في ظل استخدام الوسائل الإلكترونية لإبرام العقود الإدارية، بما يحقق وفورات مالية للدولة من خلال سرعة الإجراءات وقلة التكاليف وتدعيم المبادئ الحاكمة لإبرام العقود الإدارية. Enforcing the principle of equality as one of the most important constitutional principles requires its implementation in a fair manner at all levels and fields, especially the economic field. The economic field is one of the most important fields where this principle has to be established for the public interest to achieve sustainable development. The establishment of this principle in the economic field is more clearly embodied by making administrative contracts via electronic media. This is achieved by enforcing unified legal rules to those of the same positions who are willing to compete in making these contracts without preventing discrimination in treatment for public interest. The equality among those competing to make and enter administrative contracts is not absolute under the constraints imposed by the international and regional legislations on the principle of equality for achieving public interest. However, the practical reality confirms that the principle of equality in this field has been subjected to severe violations, which prevented its enforcement in the best manner due to collusive violations under which making administrative contracts has become a fertile field for violating this principle and derogating its provisions. Therefore, countries willing to achieve sustainable development have to shift towards making the best use of digital environment since it enables the establishment of the principle of equality in the process of making administrative contracts. In doing so, there is no direct contact between those competing to enter contracts with administration and employees under using electronic media to make administrative contracts. In this way, financial savings are achieved for the country by accelerating procedures, reducing costs and promoting principles governing the process of making administrative contracts. |
