| المستخلص: | تهدف هذه الورقة إلى تناول جدلية القانون والسياسة في فلسفة الدولة عند الفيلسوف هيغل، وذلك من خلال تناول مفهوم القانون، الذي يشير في معناه العام، إلى جملة القواعد والتشريعات التي يضعها الإنسان من أجل تطبيقها داخل المجتمع، إذ يعتبر أحد الشروط الأساسية والضرورية لتسير وتنظيم الحياة الاجتماعية، حين يحدد الحقوق والواجبات لكل فرد ينتمي إلى الدولة، وذلك بمقاربته بمفاهيم محورية في الفلسفة السياسية، على غرار الدولة والحرية والشعب. أبرز النتائج التي توصلنا إليها من خلال تحليلنا لتمفصلات إشكالية البحث، هي أن العلاقة تلازمية بين القانون والسياسة في النسق الفلسفي لدى هيغل، فمن جهة أولى؛ نجد أن الدولة لا تكون عقلانية إلا بقدر احتكامها إلى القانون والعمل وفقه، وهذا الأخير لا تتحقق ماهيته وفاعليته إلا إذا كان مستخلصا من عادات وتقاليد وثقافة الشعب، حتى لا يتعارض مع الغاية المثلى لوجوده، التي هي تحقيق الحرية وحمايتها من كل ممكن، فوجود القانون في دولة ما لا يعني بتاتا الانقاص من حرية الشعب، فلا تعارض بين القانون والحرية. This article aims to address the dialectic of law and politics in Hegel’s philosophy. Dealing with the concept of law which refers to the set of rules and legislations intended for the management of society. The law is considered as one of the fundamental conditions for the organization of the city, since it serves to define the rights and duties of each citizen, approaching it with key concepts of political philosophy, such as the State, freedom and the people the most important result we have archived through our analysis of the details of the research problematic is the correlation between law and politics in Hegel’s philosophical system, on the on hand; We find that the state is rational insofar as it invokes the law, and the latter is achieved in its essence and effectiveness only if it is drawn from the customs traditions and culture of the people, so that it does not conflict with the ultimate goal of its existence, which is the achievement of freedom and its protection from all that is possible. Reduce the freedom of the people so that there is no conflict between law and freedom. |
