| المستخلص: | الحمد لله رب العالمين، وصلى الله وسلم على نبينا محمد وعلى آله الطيبين الطاهرين، وعلى الصحابة والتابعين، ومن تبعهم بإحسان إلى يوم الدين، وبعد: فمن الألفاظ التي وردت عن الصحابة رضي الله عنهم في نقلهم لسنة النبي صلى الله عليه وسلم قولهم: (كنا نفعل كذا) أو (كانوا يفعلون)، والصحابي إما أن يضيف ذلك إلى زمن النبوة أو لا، فإذا أضاف ذلك إلى زمن النبوة فهو في حكم المرفوع في قول جماهير العلماء، وإن لم يضفه فمن العلماء من يجعل له حكم الرفع أيضا، ومنهم من يجعل له حكم الموقوف، وكثير من العلماء يعتبر هذا الموقوف حكاية عن إجماع الصحابة. وهذا القول له تطبيقات كثيرة في كتب السنة، تضمن البحث جملة منها، ويظهر من خلالها أن الغالب احتجاج العلماء بما نقل الصحابي بهذا اللفظ، وإن خالفوه فلوجود معارض راجح عندهم. والحمد لله أولا وآخرا Among the statements related from the Companions regarding their transmission of the Sunnah of the Prophet-peace and blessing upon him- is their saying: (we used to do) or (they used to do), and a Companion either ascribes such statement to the era of the Prophet or not, if he ascribes it to the era of the Prophet it takes the ruling of Al-Marfū‘(the prophetic injunction) according to the opinion of the majority of the scholars; and if did not do so, some scholars will still give it the ruling of Al-Marfū‘ also and some will give it the ruling of Al-Mawqūf, while scholars regard this Mawqūf to be a transmission of the consensus of the Companions. This statement has several applications in the Books of Sunnah, and upon close consideration, it became apparent that the most common is the scholars giving authority to whatever was transmitted with such statement, and whenever they opine in contrary, it will be due to a preponderant opposition. |
