| المستخلص: | تهدف هذه الدراسة إلى تبيين الفرق بين القراءات الواردة في لفظ (يؤلون-مهموزا-ويولون-مخففا)، ومدى تأثر أحكام الإيلاء بهذا الاختلاف، حيث إن كثيرا من الموجهين جعلوهما بمعني واحد ولم يفرقوا بينهما لا في أصل الاشتقاق ولا في اختلاف الدلالات المعنوية التي انعكس اختلافها على أحكام الإيلاء، فكان لها أثر كبير في ذلك، وخلاصة الكلام فيها وموجزه أن حمل المعاني على وجه القراءة بالهمز في (يؤلون) عائد على الإيلاء بالحلف وكلام العلماء فيه وفي أحكامه معلوم في كتب الفقه، وأما حمل المعاني على وجه القراءة بـــ (يولون) مخففا، فإنه يحتمل نفس المعاني والأحكام السابقة فتحمل هذه القراءة على أنها مؤكدة للقراءة الأولى، وعلى هذا الرأي مذهب أكثر الموجهين، وإن كان حملها عليه ضعيف من وجهة نظر الباحث، والوجه الآخر أن هذه القراءة تختلف عن الأولى لفظا ومعنى وأحكاما، فهي بمعني الإعراض والتقصير في حقوق الزوجة من غير حلف، وهذا أحكامه تختلف اختلافا كبيرا عن أحكام الإيلاء بالحلف على القراءة بالهمز في (يؤلون)، وهنا كان مكمن الإشكال والأهمية التي حاولت دراستها من خلال هذا البحث حيث إن كلا من اللفظين (يؤلون، ويولون) قد جاء له ما يؤكده ويعضده من النصوص القرآنية، وإن كان كثير من الفقهاء قد اكتفى بالاحتجاج بالأحاديث النبوية وعمل فيها بالتأويل والاجتهاد مع وجود دلالات قطعية يمكن الاستشهاد بها من خلال اختلاف معاني القراءات القرآنية التي تحدثت عن الإيلاء وأحكامه. The purpose of this study is to show the difference between the readings in the term "Yawlun - Mahmouza" and "Yulon" - and the extent of the influence of the rulings on this difference, since many of the mentors made them in one sense and did not differentiate between them, Which is reflected in the difference on the provisions of the submission, had a significant impact on it, and the summary of the speech and summarized that the carrying meanings on the face of reading Balhzz in (Yawlun) return to give the alliance and the words of scientists in it and its provisions is known in the books of jurisprudence, (Yulon) is diluted, it is likely to have the same meanings and sentences as before This reading is regarded as a certainty of the first reading, and on this view the doctrine of the most mentors, although carrying it weak from the point of view of the researcher, and the other side that this reading is different from the first word and meaning and provisions, namely the sense of negligence and default in the rights of the wife without a pact, His rulings differed significantly from the provisions of the covenant on the reading of the hymns in "Yawlun". Here, it was a matter of the problems and the importance which it attempted to study through this research, since both the words (Yawlun and Yulon) have been confirmed and supported by the Quranic texts, Many fuqaha 'scholars have merely protested the Prophet's Hadiths In which he worked in the interpretation and diligence with the existence of definitive indications can be cited through the different meanings of the Koranic readings that spoke about the submission and provisions. |
