| 520 | |a تحاول هذه الدراسة المساهمة في معالجة إشكالية تمييز جميع ضروب "المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة" عن "التعذيب"، والتي نشير إليها في هذه الدراسة ب: "مختلف أشكال سوء المعاملة" اختصارا، وذلك بالنظر إلى غياب تعريف صريح لها في مختلف الصكوك الدولية والإقليمية لحقوق الإنسان على عكس فعل "التعذيب"، لذلك ترتكز الدراسة على مناقشة فرضيتين، للحسم في محددات تلك الأفعال، تتأرجحان بين تحديد عتبة الألم بدقة )معيار الشدة( التي إذا تجاوزتها هذه الأفعال أمكن اعتبارها تعذيبا، وبين الاتفاق حول لائحة مفصلة لحصر أعمال التعذيب. وفي جميع الأحوال، فالدول مدعوة للأخذ بعين الاعتبار التمايز القائم بين تلك الانتهاكات عند تجريمها والمعاقبة عليها، وهي مطالبة في الوقت نفسه بتوفير الحماية لكل شخص من كل تلك الأفعال داخل المجال الخاضع لولايتها القضائية عن طريق اتخاذ ما يلزم من التدابير التشريعية والتدابير الأخرى التي تضمن احترام الكرامة المتأصلة في شخص الإنسان، علما أن نظرة المجتمع الواحد للتعذيب ولغيره من مختلف أشكال سوء المعاملة قد تتغير وتتطور بتطور المجتمع ذاته. وقد استقرت هذه الدراسة على عدد من التوصيات، من بينها الدعوة إلى التوافق حول تعريف ل"مختلف أشكال سوء المعاملة"، ولفت الانتباه لمخاطر إعداد قائمة حصرية بكافة الأشكال المختلفة لإيقاع الألم والمعاناة، في المقابل يمكن الاشتغال بحذر على جرد الانتهاكات وتصنيفها ضمن قائمة مفتوحة قابلة للتعديل والتتميم كلما استدعى الأمر ذلك. | ||
| 520 | |b This study attempts to contribute to addressing the problem of distinguishing all forms of "cruel, inhuman or degrading treatment or punishment" from torture, which we refer to in this study as: "various forms of ill-treatment" in short, given the absence of an explicit definition of it in various international instruments And regional human rights, in contrast to the act of "torture"; Therefore, the study is based on a discussion of two hypotheses, which oscillate between determining the precise pain threshold (the intensity criterion) that, if exceeded, by these actions could be considered torture, and the agreement on a detailed list of acts of torture. In all cases, states are called upon to take into account the distinction that exists between these violations when criminalizing and punishing them. At the same time, they are required to provide protection for every person within the field under their jurisdiction by taking the necessary legislative and other measures to ensure respect for the inherent dignity of the human being; Bearing in mind that every society’s view of these violations may change and evolve as this society develops. Among the recommendations of this study: Calling for consensus around a definition of “various forms of ill-treatment”, and drawing attention to the dangers of preparing an exclusive list of all the different forms of inflicting pain and suffering. On the other hand, it is possible to work with caution on an inventory of violations and classifying them into an open list that can be modified and completed whenever necessary. | ||
