| 520 | |a تناول هذا البحث (نفي الفارق وأثره في الاستدلال على الأحكام الشرعية مع نماذج من تطبيقاته الفقهية) وقد قسمته إلى ثلاثة مباحث، تناولت في المبحث الأول: التعريف بنفي الفارق ألفاظه وطرقه وحقيقته عند الأصوليين وهو بدوره ثلاثة مطالب، المطلب الأول: التعريف بنفي الفارق لغة واصطلاحا، المطلب الثاني: الألفاظ المطلقة على نفي الفارق، المطلب الثالث: طرق إلغاء نفي الفارق بين الأصل والفرع، وتناولت في المبحث الثاني: حقيقة نفي الفارق وحجيته عند الأصوليين، وفيه مطلبان: المطلب الأول: حقيقة نفي الفارق عند الأصوليين المطلب الثاني: حجية نفي الفارق عند الأصوليين، أما المبحث الثالث فتناولت فيه أنواع نفي الفارق مع نماذج من تطبيقاته الفقهية وفيه ثلاثة مطالب، المطلب الأول: أنواع نفي الفارق والمطلب الثاني: نماذج فقهية قطع فيها بنفي الفارق، أما المطلب الثالث: فكان نماذج فقهية نفي الفارق فيها مظنون ظنا غالبا مزاحما لليقين. | ||

According to the fundamentalists, as for the third topic, it dealt with the types of denial of the difference with examples of its jurisprudential applications, and it contains three demands, the first requirement: the types of negation of the difference and the second requirement: jurisprudential models in which the difference was excluded, while the third requirement was: jurisprudential models denying the difference in which an assumption is often contested For certainty. | ||
