المستخلص:تبنت الجزائر كغيرها من الدول لإدارة جماعاتها الإقليمية نظام اللامركزية الإدارية، وأكدت ذلك مختلف النصوص الأساسية والقوانين التطبيقية لها، لكن المعالجة القانونية لهذا الموضوع اتسمت بالعمومية مما فتح الباب واسعا أمام السلطة التنفيذية عن طريق التنظيم لتغيير توجه ما أكدت عليه النصوص الأساسية من مواثيق ودساتير فتراجع نظام اللامركزية الإدارية لصالح نظام عدم التركيز الإداري. في ورقتنا هذه نبحث الإشكالية التالية: هل النظام القانوني للبلدية الجزائرية لا مركزي أم أنه يجنح إلى نظام عدم التركيز الإداري، ذلك ما ستجيب عنه هذه الورقة البحثية باعتماد المنهج التحليلي للنصوص القانونية ذات الصلة والمنهج المقارن والمنهج العملي الميداني، لنخلص في الأخير إلى خاتمة وتوصيات نرى أنه في حالة الأخذ بها سيكون الإقلاع التنموي المحلي الذي تحققه البلدية.

Algeria, like other countries, has adopted a system of administrative decentralization to manage its regional groups, and various basic texts and application laws have affirmed this, but the legal treatment of this issue has been characterized by generalization, which has opened the door wide for the executive authority through regulation to change the orientation of the charters confirmed by the major covenants and Constitutions and the system of administrative decentralization has retreated in favor of the administrative no-focus system. In this paper, we discuss the following problem: Is the legal system of the Algerian municipality decentralized, or does it tend to the system of administrative lack of concentration? That is what this research paper will answer by adopting the analytical approach to the relevant legal texts and the comparative approach and the field practical approach, so we can finally come to a conclusion and recommendations that we believe that in the event of adoption, it will be the local development take-off achieved by the municipality.
