| المستخلص: | هذا بحث فقهي لعدد من المسائل المهمة المتعلقة بالمذاهب الفقهية الأربعة المتبوعة عند أهل العلم؛ جاء في مقدمة وخمس مسائل، وخاتمة موفورة بأهم النتائج، ثم قائمة بأهم المصادر والمراجع، عرضت فيه: تعريف المذهب الفقهي، وتعداد المذاهب الفقهية المشهورة المنقرضة، ثم بينت حكم التقليد والتمذهب، ثم الاجتهاد وطبقات المجتهدين، ثم جهود الأئمة في تدوين مذاهبهم وتصحيحها، وبيان الراجح منها، ثم ختمته بمسألة مهمة وهي: حكم التلفيق بين المذاهب وتتبع الرخص، وقد سرت فيه حسب المنهجية العلمية المتبعة عند أهل العلم في البحث العلمي. This is a research paper on jurisprudence, discussing a number of significant issues related to the four schools of jurisprudence adopted by scholars. It consists of an introduction, five issue-based sections, a conclusion including the most important results, and a bibliography comprising the most important sources and references. It presents a definition of school of jurisprudence and an inventory of some famous though extinct jurisprudence schools. It explores the legal rulings of imitation, sectarianism, ijtihad (exercising discretionary independent judgment) and classes of mujtahids (persons exercising their discretionary independent judgments). It also reviews the efforts of leading jurists in codifying and correcting their thoughts and accounts, showing the most preferred ones. The study then concludes with an important issue, namely, the ruling on fabricating reconciliation among the differing views of jurisprudence schools and tracking privileges and concessions to exploit the differing views to gain advantages. This study adopts the scientific methodology adopted by scholars in academic research. |
