| 520 | |a الفساد الإداري ظاهرة سلبية عرفتها المجتمعات الإنسانية وعانت منها منذ بدء الخليقة وحتى يومنا هذا. فهو ذو آثار سلبية على جميع النواحي الاقتصادية والمالية والإدارية والسياسية فلا توجد دولة من الدول في عصرنا إلا وأعطت لموضوع الفساد قدرا من الأهمية وذلك لخطورته واستفحاله وشموله جميع مجالات الحياة. لذلك سعت العديد من الدول ومن بينها العراق إلى اعتماد آليات ووسائل عدة لمحاربة الفساد بكل أشكاله إذ تم تأسيس العديد من الهيئات الوطنية الحكومية، وأقيمت الندوات والمؤتمرات كما اعتبرته القوانين جريمة يعاقب عليها القانون. ومن هذا كله، تتولد الحاجة لتوصيف ماهية الفساد وأثاره المدمرة، ليتسنى فيما بعد تحري دور البرلمان في مواجهته ضمن مهامه التشريعية والرقابية. وقد توصل البحث إلى نتيجة مفادها أن مظاهر الفساد، تتنوع بتنوع مظاهر النشاط الإنساني ونزعاته المادية وميله الدائم لتغليب مصلحته الخاصة على مصلحة المجتمع وأن مواجهة هذا الخطر تتم بتظافر جهود جميع السلطات والمؤسسات الرسمية وغير الرسمية في المجتمع. وفي هذا المجال يمكن التوصية ببناء دولة القانون والمؤسسات، وتعزيز مبدأ تكافؤ الفرص وتكريس العدالة والمساواة أمام القانون ومحاسبة المفسدين الكبار قبل الصغار وعدم منح حصانة لمثل هؤلاء على حساب المجتمع. مع ضرورة التركيز على معيار الشفافية في الأداء مع تبسيط وسائل العمل وترشيق حلقاته، وتحديد فترة محددة لإنجاز المعاملات واعتماد معايير النزاهة والكفاءة والعدالة عند التعيين والترقية والأداء | ||
