| المستخلص: | يدرس هذا البحث من خلال منهج وصفي تحليلي مسألة قديمة جديدة، القديم فيها: ضرب الزوجة، والجديد ما آل إليه حال الناس بين متساهل من بني جلدتنا، ومشكك من غيرهم.\nوقد بينت في هذا البحث من خلال المذاهب الأربعة أن ضرب الزوجة الناشزة حق من حقوق الزوج ولكن هذا الحق له تفاصيل في الفقه الإسلامي، تحمي المرأة من تساهل المتساهلين. وترد على سهام المغرضين.\nوقد درس هذا البحث الضوابط التي لابد منها، لمن شاء من الأزواج أن يقدم على ضرب زوجته الناشزة.\nوبينت في المقابل أن ضرب الزوجة الناشزة، وإن كانت الشريعة أباحته لظروف وبضوابط؛ إلا أنه ليس من الخيار الأحسن، بمعنى آخر أن الشريعة أباحت ضرب الناشزة، ولكنها زهدت في ضربها، وحضت على العفو، وجعلته من مكارم الأخلاق.\n This research examines through a descriptive-analytical approach a new old issue; the old one is: beating the wife, and the new is what people have turned to, there are violators from among us and there are those having skepticism over the matter.\nIn this research, I have shown through the four doctrines that beating a disobedient wife is a husband's right. However, this right has details in Islamic jurisprudence, which protects women from the aggressiveness of the aggressors, and responds to the objections raised by those with malicious objectives. \nThis research examined the necessary regulations for those husbands who wanted to beat their wives. \nOn the other hand, I pointed out that beating a disobedient wife, although the Sharia allowed it under certain circumstances and regulations; however, it is not the optimal choice. In other words, Sharia allowed beating a disobedient wife, but it discouraged beating her, urged for compassion, and made it decent moral.\nThis abstract translated by Dar AlMandumah Inc. 2020 |
