| المستخلص: | The research handles exceptions through jurisprudence of shafi’I jurisconsults save those exceptions stated for, in the book of assizes, in writing or in sharia’ norms of legality …etc. The research consists of: an introduction, prelude, three topics and a conclusion. The introduction presents goals, methodology and plan of the research. The prelude contains the definitions of: exceptions, Jurisprudence and assizes in respect to language and terminology. In the first topic, I addressed the exceptions in the chapter of conditions of considering retribution as a must, the second topic discussed the exception in the chapter of retribution fulfillment, and in the third topic I talked about the exceptions in respect to what makes retribution due except human life chapter. At last, the conclusion has come to summarize the research results. تناول البحث المستثنيات باجتهاد فقهاء الشافعية دون المستثنيات بالنص، أو بالقواعد الشرعية وغيرها، في كتاب الجنايات، ويتكون من مقدمة، وتمهيد، وثلاثة مباحث، وخاتمة، وقد كانت المقدمة في بيان أهداف البحث، ومنهج البحث، وخطته. وأشتمل التمهيد على تعريف الاستثناء في اللغة والاصطلاح، وكذلك تعريف الاجتهاد في اللغة والاصطلاح، وتعريف الجنايات في اللغة والاصطلاح. وتحدثت في المبحث الأول: عن المستثنيات في باب شروط وجوب القصاص، وفي المبحث الثاني: عن المستثنيات في باب استيفاء القصاص، وفي المبحث الثالث: عن المستثنيات في باب ما يوجب القصاص فيما دون النفس، ثم جاءت الخاتمة لتلخيص نتائج البحث. |
