| المستخلص: | تعالج هذه الدراسة موضوعاً شائكاً شكل مادة لانقسام الفقه وانعكاس ذلك على الاجتهاد، وهي تتعلق بالتساؤل عن إمكانية تحقق نشاط المتدخل في الجريمة بسلوك سلبي (امتناع)، إلى جانب السلوك الإيجابي الذي حرصت معظم القوانين، ومنها اللبناني، على تحديد وسائل التدخل حصراً، كون نشاط المتدخل في الجريمة مشروعاً بحد ذاته لولا ارتباطه بفعل الفاعل الأصلي الذي يؤلف الجريمة محل التدخل. وقد اصطلح فقهاً على تسمية السلوك السلبي للمتدخل بالمساعدة أو التدخل بالامتناع. وتكمن أهمية هذه الدراسة في ارتكازها أثناء المعالجة على الناحيتين التحليلية والتطبيقية لموقف الاجتهاد اللبناني والمقارن، اللاتيني منه والأنغلوسكسوني، كمحاولة سباقة لتفهم موقف هذه التشريعات. This study deals with a thorny issue that forms a section for the division of jurisprudence and its reflection on ijtihad (interpretative judgment), and it relates to the question of the possibility of achieving the activity of the intervenor in the crime with negative behavior (abstention), in addition to the positive behavior that most laws, including the Lebanese, are keen to specify the means of intervention exclusively because the activity of the intervenor in the crime is legitimate in itself, were it not for his association with the act of the original perpetrator who makes the crime subject of the intervention. In jurisprudence, the negative behavior of the intervenor has been termed as helping or interfering by abstinence. The importance of this study lies in its reliance during treatment on the analytical and applied aspects of the position of Lebanese and comparative ijtihad (interpretive judgment), both Latin and Anglo-Saxon, as a proactive attempt to understand the position of these legislations.
