| المستخلص: | The Purpose of Gathering in Prayer and Jurisprudential Practices in the Likelihood of its Rules (Salat Al-Jama’ah). This study aims to investigate what is meant by the purpose (Maqsad) of gathering or prayer in congregation and identify its suppositions within the rules of prayer in congregation. It also aims to identify the impact of the purpose (Maqsad) on the realization of the rules of jurisprudence to realize its jurisprudential rules. This study is significant because it shows the advantages of Sharia and good interests and reveals consistency between the partial evidence of Sharia and its whole purposes/objectives. In addition, the rules of Sharia are reasoned in a manner which the provision and meaning are consistent. The study also aims to match between the two methods of establishing branches of jurisprudence and examine the jurisprudential rules through Sharia purposes to ensure the unity of fundamental rules of jurisprudence and purposes. The researcher used the induction method to investigate the reasoned rules of prayer within the purpose of congregational prayer and the impact of this purpose in the realization of jurisprudential rules in favoring the provisions. This study consists of introduction and two sections. The introduction tackles the definition of the purpose of gathering and prayer in congregation. The first section tackles the definition of the purpose of gathering and prayer in congregation , whereas the second section tackles the impact of the purpose of gathering and congregational prayer in favoring its rules. The purpose of gathering in prayer has an impact on the realization of jurisprudential rules in favoring the rules of prayer in congregation such as ( commonness of reason that fit the purpose of gathering) and specifying the common and favoring the indication of the common and absoluteness to the restrictedness and interpreting the overall meaning and combining between the conflict understanding of evidence and priority of purposes on the means. The researcher has come up with certain findings, foremost of which are that the purpose of gathering in prayer is one of Sharia interests and genuine principles for prayer in congregation. The religious scholars have considered this purpose in favoring the matters of jurisprudence relating to prayer in congregation as a rule of Tanaful after Eqamah, repetition of congregational prayer in a mosque with a permanent Imam and rule of multitude of Friday prayer in the same country. The most consistent sayings to the purpose of gathering in prayer are those sayings which are compatible to Sharia provisions. The study also has come up with the recommendations that more focus should be given to the academic and scientific studies related to Sharia purposes in general and purpose of gathering in prayer in particular, in addition to encourage the role of the mosque as being the first kernel in realizing the interest of gathering in prayer, as well as establish research centers for strategic studies which are specialized in gathering the nation. The study also recommended to activate the role of Islamic Dawa and Cooperative associations and organizations and standardize their efforts to counter the universal economic, political and military challenges that aim to create division among Muslims through supporting the reasons and factors of such division. Finally, the study recommended to examine the positive examples of the Arab associations, councils and forums that are based on the positive cooperation and develop their performance and examine the factors of their success and obstacles of their continuation as well as how to expand the scope of their performance. تهدف الدراسة إلى بيان المراد من مقصد الألفة والاجتماع، وتتبع مظانه في أحكام صلاة الجماعة، وأثره في إعمال القواعد الأصولية لترجيح أحكامها الاجتهادية، وتكمن أهمية البحث في إظهار مزايا الشريعة؛ لما في الاجتماع والألفة من المصالح الحميدة، وإبانة مدى التواؤم بين أدلة الشريعة الجزئية ومقاصدها الكلية، وأن أحكام الشريعة معللة بصورة يتفق فيها النص والمعنى، والتوفيق في منهج البحث بين طريقتي بناء الفروع على الأصول وعرض القواعد الأصولية من خلال مقاصد الشريعة مما يقرر وحدة الأصول والمقاصد. ومنهج البحث قائم على استقراء الأحكام المعللة بمقصد الألفة واستنباط أثره في إعمال القواعد الأصولية في ترجيح أحكام صلاة الجماعة الاجتهادية، وتضمنت الدراسة تمهيداً ومبحثين، يحتوي التمهيد على تعريف مقصد الاجتماع وصلاة الجماعة. وأما المبحثان، فالأول: مقصد الألفة والاجتماع في صلاة الجماعة، والثاني: أثره في ترجيح أحكامها. وخلصت إلى مجموعة من النتائج أهمها: أن مقصد الألفة من المصالح الشرعية والمعاني الأصلية لصلاة الجماعة، وقد راعاه العلماء في ترجيح مسائل الاجتهاد المتعلقة بصلاة الجماعة كحكم التنفل بعد الإقامة، وتكرار الجماعة في مسجد له إمام راتب، وحكم تعدد الجمعة في البلد الواحد، وغيرها، وأن أوفق الأقوال مع مقصد الألفة والاجتماع أكثرُها انسجاماً مع النصوص الشرعية. وأن لمقصد الألفة والاجتماع أثراً في إعمال القواعد الأصولية في ترجيح أحكام صلاة الجماعة: (كعموم العلة المناسبة لمقصد الألفة، وتخصيصه العموم، وترجيحه دلالة العموم على التخصيص والإطلاق على التقييد، وبيانه للمجمل، وجمعه بين تعارض المفهوم للأدلة. وأولوية المقاصد على الوسائل. وأوصت الدراسة بالعناية بالأبحاث العلمية والدراسات الأكاديمية المتعلقة بالمقاصد، وتشجيع دور المسجد باعتباره النواة الأولى في تحقيق مصلحة الألفة والاجتماع، وإنشاء المراكز البحثية للدراسات الاستراتيجية والاستشرافية المتخصصة في عوامل اجتماع الأمة، وتفعيل أداء الاتحادات والمنظمات الإسلامية الدعوية والتعاونية وتوحيد جهودها؛ لمواجهة التحديات الاقتصادية والعسكرية والسياسية الأممية القائمة على أساس زرع الفرقة بين المسلمين بتغذية أسبابها وتقوية عواملها، ودراسة النماذج الإيجابية للاتحادات والمجالس واللقاءات العربية القائمة على أساس التعاون الإيجابي وتطوير أدائها ودراسة عوامل نجاحها وعوائق استمرارها، وكيفية توسيع مجال أدائها |
