| المستخلص: | يسعى البحث إلى التعرف على المسؤولية الدولية المترتبة على ارتكاب الاحتلال الإسرائيلي لجرائم ضد الإنسانية في قطاع غزة في عدوانه عام 2014، والآليات الدولية المتاحة لملاحقة الاحتلال عن تلك الجرائم. وقد خلص البحث إلى وجود مجموعة من التحديات السياسية والقانونية المتعلقة بالجانب الفلسطيني، التي تقف عقبة أمام ملاحقة مجرمي كيان الاحتلال الإسرائيلي. كما يعد تغليب المجتمع الدولي للمصالح السياسية على حساب الانتصار لضحايا الجرائم الدولية، ذات مردود سلبي على دور المحكمة الجنائية الدولية في ملاحقة المجرمين من كيان الاحتلال. وفي نهايته طالب البحث الأطراف السامية المتعاقدة على اتفاقيات جنيف سيما الرابعة بأن تقوم بواجباتها بالضغط على سلطات الاحتلال لوقف جرائمها بحق المدنيين الفلسطينيين. كما طالب باتخاذ خطوات فاعلة لإنهاء الانقسام الفلسطيني، بما يتيح الفرصة للتغلب على التحديات السياسية والقانونية المتعلقة بالجانب الفلسطيني التي تقف عقبة أمام ملاحقة مجرمي كيان الاحتلال الإسرائيلي. وطالب أيضاً مكتب المدعي العام للمحكمة الجنائية الدولية بسرعة الانتهاء من الدراسة التمهيدية والانتقال لمرحلة التحقيق في الجرائم التي ارتكبتها قوات الاحتلال الإسرائيلي بحق المدنيين في قطاع عام 2014. The search seeks to identify the international responsibility arising from the Israeli occupation of crimes against humanity in the Gaza Strip in its aggression in 2014, and available international mechanisms to prosecute the occupation for these crimes. The research concluded that there are a set of political and legal challenges related to the Palestinian side, which is an obstacle to the prosecution of the Israeli occupying entity. Moreover, the international community's preference to political interests at the expense of the victory of the victims of international crimes has a negative impact on the role of the International Criminal Court in prosecuting criminals from the occupying entity. At the end of the research, the High Contracting Parties to the Geneva Conventions, particularly the fourth, demanded that they carry out their duties by pressuring the occupation authorities to stop their crimes against Palestinian civilians. It also called for effective steps to end the Palestinian division, which would provide an opportunity to overcome the political and legal challenges related to the Palestinian side, which is an obstacle to the pursuit of criminals by the Israeli occupation. The Office of the Prosecutor of the International Criminal Court also called for the speedy completion of the preliminary study and the transition to the investigation of crimes committed by the Israeli occupying forces against civilians in the Gaza Strip in 2014. |
