| 520 | |a تعد دعوى الإلغاء من أهم الدعاوى الإدارية التي يلجأ إليها الشخص لفرض رقابة على قرارات الإدارة غير المشروعة إلاّ أن فعالية هذه الآلية تبقى مرتبطة بكيفية ممارستها، الأمر الذي دفع بالمشرع الجزائري بمراجعتها من خلال قانون الإجراءات المدنية والإدارية 08/ 09، وذلك بإعادة النظر في شروطها، واجراءاتها، وحجية الأحكام القضائية الصادرة فيها، خاصة ما تعلق منها بالتظلم المسبق، وتمثيل الهيئات الإدارية التي لا تتمتع بالشخصية المعنوية، إلزامية تمثيل المدعي بمحامي أمام المحكمة الإدارية ومجلس الدولة، بالإضافة إلى وضع حد لظاهرة امتناع الإدارة عن تنفيذ الأحكام القضائية الصادرة في دعوى الإلغاء باعتماده للغرامة التهديدية. | ||
| 520 | |b The code of civil and administrative procedure 09/08 is a basic element for the constitution of the Algerian administrative jurisdiction. Basing on it, the Algerian legislator has put conditions of actions of administrative litigation including the cancellation action that is considered as a means to preserve the precept of legitimacy in confronting administrative decisions transgressing the law. The legislator, has by this text, wants to enlarge the field of controlling administrative works by fixing it to the organic criteria. In addition, he simplified actions of litigation against litigates. Therefore, the most important among all this, it gave again value to juridical disposals dressed in an administrative action, thus, the administrator is obliged to execute it in order to represent a lawabiding state, that makes this law a model to follow. | ||
