| المستخلص: | L'autorité réglementaire en Algérie est considéré comme un des pouvoirs constitutionnels les plus importants qui reflète la supériorité de l'institution exécutive par rapport à l’autorité législative, bien que l'autorité réglementaire prise en vertu des décrets présidentiels est décrite comme indépendante de toute législation étant en rivalité, ceci les rend égaux en termes de puissance, de généralité et en statut d’ obligatio. mais elles restent néanmoins des décisions administratives soumises au contrôle judiciaire ;son existence autant que décisions réglementaires administratives est justifié par la nécessité de reconnaître à l'autorité administrative le droit d'intervenir dans l'organisation des domaines d'intérêt pour la vie des individus, en dépit du fait que l'expansion de la teneur et de la portée de l’autorité du président de la république comme une autorité réglementaire en Algérie ,le rôle du Parlement devient limitée et a tendance à se transformer en un législateur exceptionnel. The regulatory authority in Algeria is one of the most important constitutional powers that reflect the superiority of the executive institution over its legislative counterpart. Although the regulatory authority, which is carried out by presidential decrees, is described as independent of any law because it comes to compete with it, making it equal in terms of power, public and binding nature. However, this does not deprive them of their status as administrative decisions subject to judicial control, and a series of considerations that justify the need to recognize the administrative authority the right to intervene in the regulation of areas of interest to individuals although the expansion of the content and scope of the regulatory authority of the President of Algeria has limited the role of Parliament to an exceptional legislator.\nThis abstract translated by Dar AlMandumah Inc 2018. تعتبر السلطة التنظيمية في الجزائر من بين أهم الصلاحيات الدستورية التي تعكس تفوق المؤسسة التنفيذية على نظيرتها التشريعية، ورغم أن السلطة التنظيمية التي تتم بموجب مراسيم رئاسية توصف بأنها مستقلة عن أي قانون لكونها تأتي لتنافسه مما يجعلها مساوية له من حيث القوة والعمومية والصفة الإلزامية، إلا أن ذلك لا يجردها من صفتها كقرارات إدارية قابلة للرقابة القضائية، ويقف وراء وجودها كقرارات إدارية تنظيمية مجموعة من الاعتبارات تبرر ضرورة الاعتراف للسلطة الإدارية بحق التدخل في تنظيم المجالات التي تهم حياة الأفراد، على الرغم من أن التوسع في محتوى ومجال السلطة التنظيمية العائدة لرئيس الجمهورية في الجزائر جعل دور البرلمان ينحصر وينقلب إلى مشرع استثنائي. |
