| 520 | |a شريعة حمورابي من اهم الشرائع الإنسانية التي وضعت لخدمة البشرية من النواحي الاجتماعية والاقتصادية والديموغرافية، حيث أرست الأسس العملية في الحياة البشرية، وان الاهتمام بالجوانب الديموغرافية في شريعة حمورابي يعد من الموضوعات الهامة التي لم تبرز للقارئ في الأدبيات الاجتماعية، ومحاولة منا في بيان المضامين السكانية في شريعة حمورابي لتوضيح أهمية الموضوعات السكانية لدى الملوك والعلماء والمفكرين قديما وحديثا، هدفت الدراسة إلى (الكشف عن أهم المضامين الديموغرافية في شريعة حمورابي في للمجتمع العراقي القديم. والتعرف على السمات الديموغرافية للمجتمع العراقي من خلال شريعة حمورابي. وبيان الجوانب الأكثر أهمية في هذه الشريعة). وظف الباحث المنهج التاريخي ومنهج تحليل المضمون في الدراسة، وتوصلت الدراسة إلى جملة نتائج أهمها: 1. اهتمت الشرائع التي وضعها حمورابي بالحياة السكانية في المجتمع العراقي. 2. انصب اهتمامه على جميع المؤشرات السكانية (الزواج، والطلاق، والإنجاب، والتبني ...وغيرها) وهي الشريعة التي تمتاز بالشمولية في تناولها للقضايا السكانية في المجتمع. 3. حدد حمورابي شروطا قسرية للتعدد الزواجات، ومنح السلطة بيد الزوجة الأولى... وجاء ذلك حفاظا على الأسرة والنسل . 4. منع حمورابي مظاهر القتل العمدي، بل وانه حرمها وذلك لنشر روح التعاون والتعايش السلمي بين المجتمع . 5. أكد حمورابي على أن الحمل والإنجاب عمليتان مقدستان ولهما قيمة قدسية وان الطفل هو هبة الله للزوجين وحرم الإجهاض ومنعه واكد على أهمية مراعاة المرأة في الحمل. | ||
