| المستخلص: | Through our study of the various ways and methods of concluding public transactions, we note that the latter are of great importance in the management of state public funds due to the size of the budget for processing and public investment during the past two decades, in particular. They have become linked to economic and social life. Public transactions, if properly conducted and properly used, have been effective tool for solving many problems related to economic and social life, such as strengthening industry and encouraging small and medium enterprises, whose effectiveness is confirmed by economists in moving the wheels of the economic and social development of the country. Thus, through the methods and ways of concluding public transactions, we note the following:\n•\tThe Algerian legislator did not grant the management concerned with the contract the right to punish the contractor in case of falsification of the documents required from him, except for the right to temporary or final exclusion in accordance with article 52 of the Public Transactions Act. This is what opens up a wide scope for attempts to fraud and cheat by contractors in the absence of strict penal laws due to circumvention except bribery and favoritism etc. \n•\tThe law of public transactions must keep pace with economic changes, especially in light of the transition from the planned economy to the market economy and the stability of prices subject to the law of supply and demand, which affects the cost of completing the project in case of a long completion period with precise specification for conditions, modalities and reasons for reviewing and updating prices and determining responsibilities in light of the continuous re-evaluation of the project (attached). Accordingly, we conclude that public transactions are considered effective tool in the management and proper use of public funds.\n•\tThe concept of granting a contract by mutual consent has become a means of circumventing the principle of fair competition in order to initiate a monopoly by a certain party, which would be an appropriate environment for corruption that is active in all matters relating to public transactions.\n•\tThe extent of corruption prevailed in the field of public transactions has contributed to the consolidation of Algeria's ranking among the most corrupt countries in the world, according to Transparency International.\n•\tMechanisms to prevent corruption in the field of public transactions require a set of efforts and preventive legislation and the activation of various types of control while building an independent, strong and impartial judiciary free from influence, etc.\n•\tFocusing on the ethical and scientific dimension in the formation of employees who are directly related to the implementation of public projects, whether in terms of concluding a contract and selecting a customer or in terms of monitoring implementation, while instilling a spirit of moral responsibility and national spirit in the performance of professional duty.\n•\tGiving more transparency to the size and cost of public projects and ways of implementing them through various steps that will reveal gaps and manipulations with a view to enshrining the principles of governance and transparency and strengthening the dimensional control of the citizen.\nThis abstract translated by Dar AlMandumah Inc 2018. من خلال دراستنا لمختلف طرق وكيفيات إبرام الصفقات العمومية نلاحظ أن هذه الأخيرة تتمتع بأهمية كبيرة في تسيير الأموال العمومية للدولة نظرا لحجم ميزانية التجهيز والاستثمار العمومي خلال العقدين الماضيين خاصة، فقد أصبحت لها ارتباط بالحياة الاقتصادية والاجتماعية، فالصفقات العمومية إذا أحكم تسييرها وأحسن استعمالها شكلت عمليا أداة فعالة لحل العديد من المشاكل المرتبطة بالحياة الاقتصادية والاجتماعية كتدعيم الصناعة، وتشجيع المقاولات الصغرى والمتوسطة التي يؤكد الاقتصاديون فعاليتها في تحريك دواليب التنمية الاقتصادية والاجتماعية للبلاد. \nوعليه نلاحظ من خلال طرق وكيفيات إبرام الصفقات العمومية ما يلي: \n\n•\t لم يمنح المشرع الجزائري للإدارة المعنية بالعقد حق معاقبة المتعاقد معها في حالة تزوير الوثائق المطلوبة منه ما عدا حق الإقصاء المؤقت أو النهائي وفق المادة 52 من قانون الصفقات العمومية السائر المفعول، وهو ما يفتح المجال واسعا لمحاولات التدليس والغش من طرف المقاولات في ظل عدم وجود قوانين عقابية صارمة جراء التحايل ماعدا الرشوة والمحاباة وما شابه ذلك. \n•\tيجب على قانون الصفقات العمومية أن يواكب التحولات الاقتصادية خاصة في ظل التحول من الاقتصاد المخطط إلى اقتصاد السوق وعد استقرار الأسعار الخاضعة لقانون العرض والطلب والتي تؤثر على تكلفة انجاز المشروع في حالة طول مدة الانجاز مع التحديد الدقيق لشروط وكيفيات وأسباب مراجعة وتحيين الأسعار وتحديد المسؤوليات في ظل إعادة التقييم المستمر للمشروع (الملحق)، وعليه نخلص إلى القول بأن الصفقات العمومية تعتبر الأداة الفعالة في تسيير وحسن استعمال الأموال العمومية. \n•\tأصبح مفهوم منح العقد بالتراضي وسيلة للتحايل على مبدأ المنافسة الشريفة لبدأ الاحتكار من طرف جهة معينة وهو ما من شأنه أن يكون محيطا ملائما للفساد الذي يجد نشاطه في كل ما يتعلق بالصفقات العمومية. \n•\t إن حجم الفساد المتفشي في مجال الصفقات العمومية ساهم في تعزيز مرتبة الجزائر ضمن الدول الأكثر فسادا في العالم وفق منظمة الشفافية العالمية\n•\tأن آليات الوقاية من الفساد في مجال الصفقات العمومية تتطلب مجموعة الجهود والتشريعات الردعية وتفعيل مختلف أنواع الرقابة مع بناء جهاز قضائي مستقل وقوي ونزيه ومتحرر من النفوذ وغير ذلك. \n•\t التركيز على البعد الأخلاقي والعلمي في تكوين الموظفين الذين لهم علاقة مباشرة بتنفيذ المشاريع العمومية سواء من حيث إبرام العقد واختيار المتعامل أو من حيث الرقابة على التنفيذ مع زرع روح المسؤولية الأخلاقية والروح الوطنية في أداء الواجب المهني.\n•\t إعطاء المزيد من الشفافية لحجم وتكلفة المشاريع العمومية وطرق تنفيذها عبر مختلف الخطوات من شأنه كشف الثغرات والتلاعبات بهدف تكريس مبادئ الحوكمة والشفافية وتعزيز الرقابة البعدية للمواطن.\n |
