| المستخلص: | Speculation is a contract between two people, one of whom has sufficient money and wants to invest it But does not have sufficient investment experience, And someone with the necessary experience in the field of investment, but does not have the money to do so to intersect the interest of these two persons Viberman contract between them called the contract of speculation against profits agreed by the parties, But this contract overlaps and intertwines with a set of other contracts such as the company contract and deposit contract, Therefore, the research aims at explaining the concept of the Mudaraba contract and its characteristics, the provisions and the legal rules that apply to it, and the extent to which the legislation is regulated by it, It also aims at distinguishing the Mudaraba contract from other contracts that overlap and intertwine with it and to indicate the most important points of similarity and difference between them and these contracts to come out with the legal nature of this contract. إن المضاربة هي عقد بين شخصين أحدهما يملك المال الكافي ويريد استثماره ولكن ليس لديه الخبرة الكافية في الاستثمار، وشخص لديه الخبرة اللازمة في مجال الاستثمار ولكنه لا يملك المال الكافي للقيام بذلك، لذلك تتقاطع مصلحة هذين الشخصين فيبرمان عقد بينهما يسمى عقد المضاربة مقابل أرباح يتفق عليها الطرفان، ولكن هذا العقد يتداخل ويتشابك مع مجموعة عقود أخرى كعقد الشركة وعقد الوديعة، لذلك يهدف البحث إلى بيان مفهوم عقد المضاربة وخصائصه والأحكام والقواعد القانونية التي تنطبق عليه ومدى تنظيم التشريعات لها من جهة أولى، كما يهدف إلى تمييز عقد المضاربة عن غيره من العقود الأخرى التي يتداخل ويتشابك معها وبيان أهم نقاط التشابه والاختلاف بينه وبين هذه العقود لنخرج بالطبيعة القانونية لهذا العقد. |
