| 520 | |a الحمد لله والصلاة والسلام على خير خلق الله نبينا محمد صلى الله عليه وسلم، وبعد\nفإن هذا البحث يناقش ظاهرة خطف القضاة في الفقه الإسلامي والقانون اليمني- دراسة مقارنة، مع ذكر آراء الفقهاء فيها وشراح القانون، وقد تناول مفهوم ظاهرة الخطف في الاصطلاح اللغوي والفقهي، والوظيفة الأساسية من وجود القضاء، وشروط تعيين القاضي في الفقه وما هو المعمول به في القانون اليمني، مع بيان أوجه الاتفاق والاختلاف بينهما، وتناول البحث أيضا ظاهرة الخطف وأركانها والعقوبة المقررة لها في الشرع والقانون، ويناقش البحث خصوصا الآثار السلبية الناتجة عن هذه الظاهرة، وهي التدخل في شؤون القضاء والحد من استقلاليته في إصدار الأحكام القضائية، وصور إهانة القضاء المتمثلة في الإهانة بالقول والفعل والكتابة والتهديد، مع بيان العقوبة الشرعية والقانونية لكل صورة من هذه الصور، وقد اعتمد البحث على المنهج الوصفي الاستقرائي وذلك باستقراء آراء الفقهاء وموقف القانون اليمني مع المناقشة والتحليل الأدلة كل فريق منهم، كما يقوم البحث باستقراء مواد قانون الجرائم والعقوبات اليمني، وقانون السلطة القضائية التي هي قيد البحث والتحليل، وأخيرا تناول البحث الخاتمة التي أظهرت أهم النتائج وأهم التوصيات التي تم التوصل إليها إليها الباحث في هذا البحث. | ||
| 520 | |f Praise be to Allaah and blessings and peace be upon His best creation, our Prophet Muhammad (peace and blessings of Allaah be upon him).\nThis research discusses the phenomenon of abducting judges under Islamic jurisprudence and Yemeni law — a comparative study, mentioning the opinions of the scholars (of jurisprudence) and the commentators of the law. The study discussed the concept of kidnapping in language and jurisprudence and the primary function of the existence of the judiciary. The study also explained the conditions for appointing a judge in Islamic jurisprudence, and what is in practice under the Yemeni law as well as the aspects of the agreement and disagreements between the two. The research also dealt with the phenomenon of kidnapping, its foundations, and the punishment prescribed for it in sharia and the law. The research discusses, in particular, the negative effects of this phenomenon, i.e., the interference in the affairs of the judiciary and the limitation of its independence in the issuance of rulings, the forms of insulting the judiciary by insulting words, acts, writing and threats, besides explaining the Shari' and legal punishment for each of these forms. The research relied on the descriptive and inductive approach by extrapolating the opinions of jurists and the position of Yemeni law by discussing and analyzing the evidence of each group. The research also extrapolated the articles of the Yemeni Crimes and Penalties Code and the Judicial Authority Law that are under consideration and analysis.
