| المستخلص: | تهدف هذه الدراسة إلى محاولة معرفة آثار عقد الاعتماد الإيجاري، وهل هي نفس الآثار التي تترتب على عقد الإيجار التقليدي طبقا للقواعد العامة؟ آم أنها تتميز بخصوصية، لا سيما وان دور المؤجر في عقد الاعتماد الإيجاري هو دور تمويلي بحت. هذا ما سنحاول معرفته من خلال هذا المقال. وللإجابة على التساؤل المطروح فإننا سنعرض لأثار هذا العقد بالنسبة للمؤجر وللمستأجر وذلك في مبحثين نعرض في الأول لالتزامات المؤجر وف الثاني لالتزامات المستأجر . وقد خلصنا بأنه يجب أن لا يغيب عنا، بان الآثار القانونية لعقد الاعتماد الإيجاري يمكن التعرف إليها من خلال الغاية التي وجد من أجلها هذا العقد، وهي توفير الضمانات الكافية للمؤجر باعتباره ممولا ليس إلا The objective of this research is an attempt to understand (or identify) the effects of a commercial accreditation contract, by spelling out if these effects are similar to those we find in traditional commercial contract with in the context of general rules, or does these effects have their own characteristics having in mind that the role of the less or within the accreditation commercial contract is only a role of a funds provider. This is what we will attempt to determine throughout this research. In order to answer the question, we will present the effects of this contract to the lessor and the lessee in two areas, which are presented in the first to the lessor’s obligations and the second to the lessee’s obligations Le but de cette étude est d’essayer de déterminer les effets du contrat de location, ils mêmes que les effets du contrats de location traditionnels selon les régtes générales ? ou bien est caractérisé. D’autant plus que le rôles du bailleur dans le contrat de bail est une recherche de rôle de financement .c’est ce que nous allons essayer de savoir dans cet article. Afin de répendre a la question , nous présenterons les effets de contrat au baille et au locataire dans deux sous titre, présentés en premier dans les obligation du bailleur et dans le second en ce qui concerne les obligations du locataire. |
