| المستخلص: | تتمتّع القدس ببعدها الإنساني والتاريخي والسياسي الكبير. مما جعلها هدفا لمطالبات تاريخية متناقضة بين اليهود والعرب الفلسطينيين. ناهيك عن البعد الديني، حيث أن كِلا الشعبين يعتبران أن المدينة تُجسّد الهوية الروحية والحق التاريخي لكل منهما. وهو ما استغلته الحركة الصهيونية، بتحويل الأسطورة الدينية إلى مشروع سياسي قاضي بتهويد المدينة، بما يؤجج الصراعات، ويهدد بتغيير طابع المدينة ويقضي على أي فرصة في تحقيق حل الدولتين. وبما أن المجتمع الدولي قد ضل لأكثر من نصف قرن يبحث عن وضع خاص لمدينة القدس. فانه في قواعد القانون الدولي الحالية يجب رسم عناصر الحل. مما يستلزم أن أهمية القدس الدينية والتاريخية ليس لها أي تأثير على الحجج القانونية حول وضع المدينة في القانون الدولي. Jerusalem has a great human, historical and political dimension. Making it a target for contradictory historical claims between Jews and Palestinian Arabs. Not to mention the religious dimension, since both peoples consider that the city embodies the spiritual identity and historical right of each. Which has been exploited by the Zionist movement, turning the religious myth into a political project by Judaizing the city, Which escalate conflicts, and threatening to change the character of the city and eliminate any chance of achieving a two-state solution. And as the international community has been straying for more than half a century in search of a special status for the city of Jerusalem. It is in the existing norms of international law that the elements of a solution must be drawn. This requires that the importance of religious and historical Jerusalem has no impact on legal arguments about the status of the city in international law. Jérusalem a une grande dimension humaine, historique et politique. Ce qui en fait une cible pour les revendications historiques contradictoires entre Juifs et Arabes palestiniens. Sans parler de la dimension religieuse, puisque les deux peuples considèrent que la ville incarne l'identité spirituelle et le droit historique de chacun. Ce qui a été exploité par le mouvement sioniste, transformant le mythe religieux en un projet politique de judaïsation de la ville, entraînant une escalade des conflits et menaçant de changer le caractère de la ville et d'éliminer toute chance de parvenir à une solution à deux États. Et comme la communauté internationale s'égare depuis plus d'un demi-siècle à la recherche d'un statut spécial pour la ville de Jérusalem. C’est dans les normes existantes du droit international que les éléments d’une solution doivent être tirés. Cela nécessite que l'importance de Jérusalem religieuse et historique n'ait aucun impact sur les arguments juridiques concernant le statut de la ville en droit international. |
