| المستخلص: | بحث فقهي مقارن حاولت من خلاله أن أعالج نازلة فقهية انتشرت في الآونة الأخيرة انتشارا كبيرا، وهي النقود الإلكترونية وما يتعلق بها من أحكام فقهية ببيان حقيقتها وخصائصها، ومميزاتها محاولا تكييف التعامل بالنقود الإلكترونية تكييفا فقهيا، واخترت عملة بتكوين لتكون نموذجا للدراسة نظرا لانتشارها فحاولت دراستها والتعرف عليها فقها واقتصادا، وهل ينطبق عليها وظائف النقد؟، وهل تحقق ما يحققه النقد عند علماء الفقه والاقتصاد؟ فتكلمت عن حقيقة النقود، ووظائفها ومدى انطباق هذه الوظائف على البتكوين، ثم تطرقت لبيان جهة إصدار العملة في الفقه والاقتصاد، وفصلت أقوال الفقهاء المعاصرين في حكم التعامل بالبتكوين، واخترت القول القائل بحرمة تداولها نظرا لقوة ما استدلوا به ولموافقته لمقاصد الشريعة التي من بينها الحفاظ على المال. وختمت البحث بأهم النتائج التي توصلت إليها من خلال البحث. وبالله التوفيق This is a juristic (Feqhi) research I'm handling through it a juristic question that has a great spread recently; the Bitcoin and their juristic rulings, I'm indicating their identity, features and specialties, in an attempt to adjust it juristically. I have chosen the Bitcoin as an example because of it's propagation, so I examined it in both economic and Islamic jurisprudence , and see whether it applies to the functions or serves the same as cash according to the scholars’ jurisprudence and economic views . . I mentioned the identity of cash money, it's functions and to which these functions apply to the bit coins. After that I have indicated the destination in which this currency is issued according to Feqh and economy and mentioned in details the modern Feqh scholars sayings about using the bit coins. I have adopted the saying that trading with Bitcoin is forbidden (Haram); due to the strong proofs that goes in line with the purposes of the Islamic laws that protecting one’s money is one of them. I concluded the research with the more important results I have got from the research. |
