| 520 | |b Corruption causes significant dangers on various life domains, particularly the political one, the fact that makes it a crucial topic to discuss as long as it is strictly related to democracy and civil human rights besides political issues were the results of conflicts and tensions between government and individuals ,she has written the writings of constitutional jurisprudence and the theorists of social doctrine ; It can be said that the years following the second world war were a decisive step in the establishment of many basic human rights and liberties ; due to the shift in the traditional function of the state to the state's legal, constitutional or civil demands, the legislative freedom of expression and the media from its narrow space confined to the category of professionals has been gradually enhanced by the freedom of administrative media or the freedom to access and enable information, In human rights instruments and conventions are guaranteed to everyone. The present article randles legal organization of the rights of having data documents and statistics, as well as the possibility of applying article N° 51 of the Algerian constitution recently modified. Also the study discusses about the role of transparency on the general life as a means of fighting corruption, especially in the field of elections ;and a need for special legislation Strengthening the rule of popular control over the management of electoral processes. | ||
| 520 | |a يلحق الفساد ضررا بالغا بمختلف مناحي الحياة ولا سيما السياسية منها وهي مشكلة تقلق الرأي العام وبخاصة عندما يتعلق الأمر بمسألة ترتبط بالديمقراطية وحقوق الإنسان المدنية والسياسية، هاته الأخيرة التي كانت نتاج صراع مرير وتدافع بين السلطة والأفراد هيأت لها كتابات الفقه الدستوري ومنظور المذهب الاجتماعي، ويمكن القول أن السنوات التي تلت الحرب العالمية الثانية كانت منعرجا حاسما في إرساء عديد الحقوق والحريات الأساسية للإنسان، وبفضل التحول في الوظيفة التقليدية للدولة أمام مطالب الدولة القانونية أو المدنية الحديثة تجسمت بصفة تدريجية وثبة تشريعية نقلت حرية التعبير والإعلام من حيزها الضيق المحصور على فئة المهنيين إلى حرية الإعلام الإداري أو حرية النفاذ إلى المعلومات والتمكين منها، كما هو متعارف عليه في صكوك واتفاقيات حقوق الإنسان لتصبح مكفولة لكل فرد. لذا يناقش المقال التنظيم القانوني لحرية الحصول على المعلومات والوثائق والإحصائيات ونقلها على ضوء المبدأ الدستوري المنصوص عليه في المادة 51 من الدستوري الجزائري المعدل أخيرا، ولما له من دور في إضفاء الشفافية على الحياة العامة كوسيلة لمكافحة الفساد وخاصة في مجال الانتخابات، والحاجة إلى تشريع خاص لتعزيز قاعدة الرقابة الشعبية على إدارة العمليات الانتخابية تكريسا للديموقراطية التشاركية. | ||
