| 520 | |b Nurse liability for his/her mistake and negligence and physician or hospitals in general liability for their subordinates has not been addressed by the Jordanian legislative through special provisions in the medical laws or through regulating the nursing profession which made this matter subject to the civil or omission liability of the Jordanian Civil Law as well as the liability of subordinates for their acts. The existence of this liability led to the rise of many problems. These problems are related to the nature and foundation of such liability and the chief in charge liability as well as determination of the acts, which are considered as mistake and negligence by the nurse, when the nurse liability is independent and the higher chief in charge right to have recourse against the nurse. These are the objectives and problematic of the study. The researcher used the analytic approach in this research and studying the Jordanian Civil Law provisions as well as referring to the Jordanian Cassation Court awards. The present study aimed to identify the nurse’s liability arising from his/her mistake and negligence. It was found that it’s an omission liability towards the patient and contracting liability towards the employer and that chief in charge is liable for the nurse mistake or negligence where this liability is not independent of the supervisory physician or employer liability. The recommendations concluded by the researcher: the researcher recommends that new legislations for regulating the nurses' work, rights and obligations on their mistakes and negligence should be enacted as well as for the purpose of regulating their relations with their employers, to make it easier for the damaged person to prove and establish such mistake and negligence, the nurse liability extent for his mistake and negligence and the recourse of the chief in charge on the nurse in the event that the nurse mistake and omission is established and proven in certain cases. | ||
| 520 | |a مسؤولية الممرض عن خطأه وإهماله لم يتعرض لها المشرع الأردني، بنصوص خاصة في القوانين الطبية، أو مسؤولية الأطباء عن تابعيهم أو المستشفيات بصفة عامة، أو من خلال تنظيم مهنة الممرضين مما جعل هذا الموضوع يخضع للمسؤولية المدنية أو التقصيرية للقانون المدني الأردني، هذه المسؤولية تثير كثيراً من الإشكاليات عن طبيعة هذه المسؤولية. ومسؤولية المتبوع وأساس هذه المسؤولية، وكذلك تحديد الأعمال التي تعتبر خطأً وإهمالاً من قبل الممرض، ومتى تستقل مسؤولية الممرض عن المتبوع وحق المتبوع بالرجوع على الممرض، تهدف هذه الدراسة واشكالياتها إلى بيان مسؤولية الممرض عن خطأه وإهماله. هي مسؤولية تقصيرية بالنسبة للمريض وعقدية بالنسبة إلى الجهة التي يعمل لديها وأن المتبوع مسؤول عن خطأ وإهمال الممرض، ولا تستقل هذه المسؤولية عن مسؤولية الطبيب المشرف أو الجهة التي يعمل لديها وأما التوصيات فإن الباحث يوصي بإصدار تشريعات تنظم عمل الممرضين وحقوقهم والتزاماتهم عن خطأهم، وتنظيم علاقاتهم مع الجهات التي يعملون لديها، والتيسير على المتضرر من إثبات الخطأ والإهمال، ومدى مساءلة الممرض عن الخطأ والإهمال، ورجوع المتبوع على الممرض في حالة ثبوت خطأ وإهمال الممرض في حالات معينة. | ||
