| المستخلص: | Human rights are considered a contemporary issue, its respect and defending represents the civilized side of the Arab human conscience. All international standards have agreed to provide maximum protection of human rights through a range of guarantees, whether under normal circumstances or under exceptional circumstances. This study addresses the most important aspects of the legal and judicial protection of human rights in light of the declaration of the state of emergency under the Jordanian Constitution of 1952 and its amendments. The study discusses the legal and judicial guarantees to protect the rights and freedoms of individuals in accordance with the Jordanian constitution in times of proclaiming public emergency in which theses rights and freedoms are restricted in order to maintain security and stability. The study also pointed the most important problems facing legal and judicial guarantees and their effectiveness in protecting human rights in light of the state of emergency, and the prominent role played by the Constitutional Court in protecting the rights of individuals and freedoms under the state of declaring emergency. تعد قضية حقوق الإنسان من القضايا المعاصرة وإن احترامها والدفاع عنها يمثل الجانب المتحضر في الضمير العربي الإنساني، فاتفقت جميع المعاير الدولية على توفير حماية قصوى لحقوق الإنسان من خلال جملة من الضمانات سواء كان في ظل الظروف الاعتيادية أو في ظل الظروف الاستثنائية. تناولت هذه الدراسة أهم ملامح الحماية القانونية والقضائية لحقوق الإنسان في ظل إعلان حالة الطوارئ في الدستور الأردني لسنة 1952 وتعديلاته، حيث تناولت هذه الدراسة البحث في الضمانات القانونية والقضائية لحماية حقوق الأفراد والحريات وفقاً للدستور الأردني في ظل إعلان حالة الطوارئ والتي بموجبها يتم تقييد حقوق الأفراد وحرياتهم من أجل المحافظة على الأمن والاستقرار، كما أشارت هذه الدراسة إلى أهم الإشكاليات والجدليات التي تواجه الضمانات القانونية والقضائية ومدى فعاليتها في حماية حقوق الإنسان في ظل إعلان حالة الطوارئ، والوقوف على الدور البارز الذي تمارسه المحكمة الدستورية في توفير الحماية لحقوق الأفراد والحريات في ظل إعلان حالة الطارئ. |
