| المستخلص: | تناول البحث موضوع "الصكوك الإسلامية" كمنتج شرعي بديلاً عن الأدوات الربوية، ودورها في المساهمة في عملية التنمية الاقتصادية.\nوقد اقتضت طبيعة هذا البحث أن أقسمه إلى مقدمة، وثلاثة مباحث، وخاتمة.\n-\tوقد تحدثت في مقدمته؛ عن أهمية هذا الموضوع، وأسباب اختياري له، والمنهج المتبع في إعداده، وخطة البحث فيه.\n-\tثم جعلت المبحث الأول في بيان هذا المنتج المستحدث حيث تناولت فيه المفهوم اللغوي والاصطلاحي للصكوك الإسلامية، وتاريخها، والهدف من إصدارها، وخصائصها، وأنواعها والفرق بينها وبين ما يشبهها من الأدوات المالية الأخرى.\n-\tويأتي المبحث الثاني: في الأحكام الشرعية للتعامل بالصكوك الإسلامية من حيث التكييف الفقهي لها، والموقف الشرعي لتداول وإطفاء الصكوك، وشراء الصك بغرض بيعه أو المتاجرة فيه.\n-\tثم تناولت في المبحث الثالث: دور الصكوك الإسلامية في المساهمة في عملية التنمية الاقتصادية، وعلاجها لمشكلة البطالة، والأموال المعطلة، وبيان أهم ما يميز هذه الأداة كمنتج إسلامي بديلا عن الربا، وما هي أهم العقبات التي تواجهها. وذيلت هذا المبحث بمطلب تناولت فيه الضوابط الفنية والشرعية للصكوك الإسلامية.\n-\tالخاتمة؛ وبها أهم نتائج البحث.\t\nثم ذيلت البحث بفهارس شاملة تتيح للمطلع سهولة الرجوع إلى ما يريد والاستفادة منه. The research dealt with the topic of Islamic instruments as an alternative to riba-based instruments and their role in contributing to economic development.\nThe nature of this research required me to divide it into an introduction, three topics, and a conclusion.\n- In the introduction, I spoke about the importance of this topic, the reasons for choosing it, the approach followed in its preparation, and the plan of research.\n- Then I made the first topic about this new term, where I dealt with the linguistic and idiomatic concept of Islamic Sukuk, its history, the purpose of its issuance, its characteristics, types and the difference between Sukuk and other similar financial instruments.\n- The second subject is about the sharia rulings on dealing with Islamic Sukuk in terms of their Fiqhi (jurisprudential) adaptation, the stance of Sharia to the circulation, and suppression of Sukuk and buying a cheque for the purpose of selling or trading in it.\n- Then in the third topic, I have dealt with the role of Islamic instruments in contributing to the economic development process, addressing the problem of unemployment and obstructed funds, and explaining the main characteristics of this instrument as an Islamic product that is an alternative to riba, and explained what are the most important obstacles it faces. This topic was appended to a sub-topic in which I have dealt with the technical and legal rules of Islamic Sukuk (instruments).\n- The conclusion; it consists of the most important results of the research.\nThe search was followed by comprehensive indexes that enable the learner to refer to and benefit from what he wants easily.This abstract translated by Dar AlMandumah Inc. 2018\n |
