| المستخلص: | يتناول هذا البحث قادحاً مهماً من قوادح القياس، وهو قادح الفرق، والتطبيق عليه من الأقيسة في مسائل أصول الفقه، وقد حصر الباحث من ذلك ما يقارب مائة قياس مقدوحاً فيها بذلك، ونظراً لمحدودية البحوث التي تنشر في المجلات العلمية رأي الاقتصار من ذلك على بعض مسائل دلالات المنطوق، فجعله تحت عنوان: أثر الفرق في الاحتجاج بالقياس في بعض دلالات المنطوق. وقد حوى البحث مقدمة، وتمهيداً، وثلاثة مباحث، ففي التمهيد: تم التعريف بالفرق، والقياس، والمنطوق، وبيان أثر الفرق في حجية القياس. وفي المبحث الأول عرض الباحث: أثر الفرق في الاحتجاج بالقياس في صيغة الأمر، وفي دلالة الأمر المطلق على الوجوب، وفي دلالة الأمر المطلق على الفور، وفي دلالة الأمر على التكرار، وفي دلالة الأمر المعلق على شرط أو صفة على التكرار، وفي دلالة صيغة النهي المجردة، وفي اقتضاء النهي المطلق للفور والتكرار. وفي المبحث الثاني عرض: أثر الفرق في الاحتجاج بالقياس في دلالة العام على أفراده، وفي دخول النساء في الخطاب الذي ظهرت فيه علامة التذكير، وفي عموم الخطاب الموجه للنبي صلى الله عليه وسلم، أو لأحد من الصحابة رضي الله عنهم، وفي عموم الفعل في مفعولاته، وفي حمل المشترك على معانيه. وفي المبحث الثالث عرض: أثر الفرق في الاحتجاج بالقياس في تخصيص القرآن والسنة المتواترة بخبر الواحد، وفي تخصيص العموم بقول الصحابي، وفي اشتراط اتصال المستثنى بالمستثنى منه، وفي استثناء الأكثر، وفي عود الاستثناء المتعقب جملاً متعددة، وفي مسألة تأخير البيان. وقد اتضح من خلال البحث أن قادح الفرق حجة ومعتبر، ومؤثر في القياس على رأي جماهير أهل العلم من الأصوليين والفقهاء، وأنه ورد على كثير من الأقيسة الأصولية في دلالة المنطوق فأدى إلى بطلان القياس فيها. this research examines one of the most important nullifications of inference, which is the difference, application in juristic principles questions. Accordingly, the researcher limited approximately one hundred nullified inference. Given the limited researches and studies in scientific fields, the researcher decided to confined to question of rhythmical semantic, entitled (The Effect of Differences in Argumentation by Inference in the Significance of The Literal Meaning). This research includes an introduction, preface, three topics. The preface demonstrated the definition of the difference, inference, literal meaning, evidence of the effect of the difference in inference. The first topic: the researcher The Differences in Argumentation by Inference in imperative, the inference with difference in the significance of absolute imperative to the obligation, the inference with difference in the significance of absolute imperative to Assertory, the inference with difference in the significance of absolute imperative to frequency, the inference with difference in the significance of abstract negative imperative, the inference with difference in obligation of negative imperative of assertory and frequency. The second topic: the researcher demonstrated The Effect of Differences in Argumentation by Inference in the significance of general to individual, inference with difference in women engagement in disquisition in which women demonstrate masculine significance, inference with difference in general disquisition addressed to the Prophet Mohammed (All Prayers and Blessings of Allah be upon him) or one of his companions (May Allah be pleased with them), inference with difference in general subject significance to object, inference with difference in maintenance of the joint to its meanings. The third topic: the researcher explained The Effect of Differences in Argumentation by Inference in Specification of the Generalities of Koran and recurrent sunnah, the inference with difference in Specification of the Generalities based on prophet's companion saying, the inference with difference in condition of connecting of excepted to the excepted from, the inference with difference in the exception of the greater, the inference with difference in delaying evidence question. The research revealed that the difference nullification is a considerable evidence, an influential factor in the interference by analogy based on fundamentalists and juristic scholars, as well as the difference nullification was stated in fundamental analogies in the Significance of Rhythm, resulted in the nullification of inference by analogy. |
