| المستخلص: | The Independent High Electoral Monitoring Commission of Algeria and Tunisia are the institutional aspect of the protection of the electoral process at all stages. The tendency of the Algerian and Tunisian constitutional founders to establish it as per the constitutional provisions is a guarantee that strengthens their organic and functional independence. On the other hand, however, the impartiality of its president and members can be guaranteed only by providing a set of legal guarantees that establish their independence from the executive branch or against the parties to the electoral process. This is an important indicator of their neutrality, which in turn ensures good decision-making and job stability during their assignment term.\nThis abstract translated by Dar AlMandumah Inc 2018. La Haute Instance Indépendante de Surveillance des Elections en Algérie et en Tunisie, ce qui représente le côté institutionnel pour protéger le processus électoral à toutes ses étapes, où on peut considérée que le choix du fondateur constitutionnel algérienne et tunisienne à sa création en vertu des dispositions constitutionnelles comme garantissent renforcer l'indépendance organique et fonctionnelle, Mais en revanche, il ne peut pas garantir l'impartialité de son président et que ses membres que par fournir une série des garanties juridiques qui consacrée leur indépendance par rapport au pouvoir exécutif ou face à des parties au processus électoral, ce qui est un indicateur important d'impartialité Contrairement à assurer une bonne prise de décision et d'assurer la stabilité de carrière pendant la durée de leur mission. تمثل الهيئة العليا المستقلة لمراقبة الانتخابات في الجزائر وتونس الجانب المؤسساتي لحماية العملية الانتخابية في جميع مراحلها، حيث يعتبر توجه المؤسس الدستوري الجزائري والتونسي إلي استحداثها بموجب الأحكام الدستورية ضمانة تعزز استقلاليتها العضوية والوظيفية، لكن في المقابل لا يمكن ضمان حياد رئيسها وأعضائها إلا بتوفير مجموعة من الضمانات القانونية التي تكرس استقلاليتهم عن السلطة التنفيذية أو في مواجهة أطراف العملية الانتخابية، والتي تعتبر كمؤشر مهم علي حيادهم بما يضمن في المقابل حسن اتخاذ القرار وضمان استقرارهم الوظيفي خلال مدة انتدابهم. |
