| المستخلص: | الحمد لله رب العالمين، والصلاة والسلام على أشرف الأنبياء والمرسلين نبينا محمد وعلى آله وصحبه أجمعين ،،، أما بعد: فإن من إرادة الله تعالى بالعبد خيرا تيسير طريق العلم والتفقه في الدين، كما قال: (من يرد الله به خيرا يفقهه في الدين) ، وإن الناظر في الشريعة الإسلامية الغراء يلحظ المكانة العالية التي يحتلها النكاح، وذلك لما ينتج عنه من ثمرات جمة يعود نفعها على الفرد، والمجتمع، والأمة، لذا أوضح الشارع الحكيم أهدافه، ومقاصده السامية، ووضع القواعد الثابتة لقيام حياة زوجية مثمرة، ولكن قد يعترض الحياة الزوجية ما يحول دون استمرارها؛ لأن الإنسان محل للعوارض التي تطرأ على بني البشر، ومن تلك العوارض الأمراض المعدية والتي يتضرر منها الطرف الآخر فى الحياة الزوجية، وذلك لما يصاحب هذه الأمراض المعدية من آثار سيئة قد تؤدي إلى الوفاة؛ لذلك كله كان اختياري لهذا البحث الموسوم بــــــــ (أثر الأمراض المعدية في الخيار بين الزوجين وأحقية الحضانة). Praise be to Allaah, the Lord of the Worlds, and blessings and peace be upon the most honorable prophets and messengers, our Prophet Muhammad, and all his family and companions. Following this, it is the will of Allaah for the slave that is better, to facilitate the path of knowledge and understanding of religion, as he said: “Whoever Allah wishes good will grant him understanding in religion.” The person who looks at the pure Islamic Shariah (law) will notice the high status that marriage occupies, because of the great fruits that it produces, which benefits the individual, society and the nation. Thus, the wise Shari’ (legislator) explained his goals and noble purposes and laid down the established rules for the establishment of a productive matrimonial life, but marital life may be obstructed to prevent it from continuing. Because human beings are the subject of symptoms that occur in human beings, and such symptoms are infectious diseases that affect the other side of marital life. This is because of the adverse effects associated with these infectious diseases that may lead to death. Therefore, my choice was made for this research, which is described as “the effect of infectious diseases on the choice between spouses and the right to custody”. \nThis abstract translated by Dar AlMandumah Inc. 2018 |
