| المستخلص: | الطلاق من الأمور ذات الأثر الكبير على مستوى الأفراد والمجتمعات، ولقد عني الشرع الحكيم والفقهاء بتبيين أحكامه وتوضيح حدوده، وبيان ضوابطه وقيوده، ومع تطور الحياة وظهور التقنين في البلاد العربية والإسلامية ظهر ما يعرف بالطلاق الشفوي، ذلك الطلاق الذي لم يقم الزوج بالإشهاد عليه، أو توثيقه في الأوراق الرسمية المعدة لهذا الغرض، بعدما أوجب القانون في مصر ذلك. فهل يقع هذا الطلاق – شرعا – إذا رفض الزوج أو لم يقم بالأشهاد عليه أو توثيقه رسميا بعد صدوره منه مستوفيا أركانه وشروطه؟ أم لا؟ وقد حاولت من خلال هذا البحث الإجابة على هذا التساؤل من خلال توضيح ماهية الطلاق الشفوي الذي عنها الفقهاء واشتهر بين العامة بهذا المسمى، وحكمه وأثره على عقد الزواج من الناحية الشرعية، مع بيان الرأي الراجح – من وجهة نظرنا والله أعلى وأعلم – وما نصت عليه قوانين الأحوال الشخصية في مصر. Oral Divorce between Islamic Jurisprudence and Personal Status Laws in Egypt Divorce has a great impact on individuals and societies, and so the Sharia and jurists were keen on clarifying its provisions, limits and conditions. Due to the development of life and the introduction of codification in the Arab and Islamic countries, the so-called oral divorce has emerged. In this type of divorce the husband does not seek witnesses or document it in the official documents prepared for this purpose, as required by the law in Egypt. Therefore, does this oral divorce – according to Sharia – take place or not if the husband rejects or does not seek witnesses or document it officially after being uttered by him, with all its rules and conditions fulfilled? I have tried through this research to answer this question by clarifying the meaning of oral divorce, as meant by jurists and known among the public by this name, as well as its ruling and impact on the marriage contract from the sharia point of view, showing the most correct opinion - from our point of view, and Allah knows best – and what is provided for in the personal status laws in Egypt. |
