| المستخلص: | في ظل التطور الحضاري الذي يشهده المجتمع الإسلامي، تعتبر المعاملات المالية من أهم مصادر الإزعاج والخلاف بين الزوجين، لا سيما الثروة المشتركة بينهما، فمن المعلوم أنه في حالات كثيرة تسهم الزوجة في الثروة الناتجة خلال الحياة الزوجية؛ فهي تشارك الزوج في أمواله خدمة وتنمية وتطويرا، دون أن تلجا الزوجة لتوثيق مساهمتها سعيا لإثبات حقها، اعتماداً على طابع المحبة والمودة والمكارمة والبذل والعطاء الذي يوشح الحياة الزوجية ويعد مقوما أساسيا في هذه الرابطة. لكن عند حدوث العوائق وبروز بوادر الانفصال تبرز إلى العيان القضايا المالية بين الزوجين وما يقع فيها من نزاع شديد، تزول معه كل معاني المسامحة والفضل، وهذا ما يشهد به ما يعرض في المحاكم، وما يصدر عنها من أحكام قضائية متنوعة ومختلفة في هذا الباب، تشترك جميعا في محاولة فصل الذمة المالية للزوجين.
