| المستخلص: | تناولت الدراسة دور البصمة الوراثية كإحدى أهم التقنيات العلمية التي أسهمت في تفعيل العمل الشرطي وضبط الجرائم ومرتكبيها من خلال دراسة تأصيلية تحليلية اعتمد الباحث في شقها الأول على محاولة إيجاد تعريف موجز للبصمة الوراثية، كما أشار إلى أهميتها وخصائصها.\nوفي الشق الثاني ناقش الباحث مشروعية البصمة الوراثية بعدما ظهر اتجاه فقهي يرى أنها تنتهك حقوق الفرد، وأكد ضرورة وضع ضوابط تشريعية تنظم هذا الإجراء، وتعاقب على إساءة استغلاله، وألا يكون مباحاً في جميع الدعاوى.\nوفي الأخير خلصت الدراسة إلى التوصيات الآتية:\t\n1.\tدعم أجهزة الشرطة ومختبراتها بأحدث أجهزة تحليل البصمة الوراثية.\t\n2.\tإصدار \tتشريع يشتمل على شروط اللجوء إلى الحمض النووي، بما يضمن عدم إساءة استخدام \tالنتائج التي تسفر عنه.\n3.\tاستقلالية المختبرات القائمة بتحليل الحمض النووي وأن تكون تحت رقابة صارمة. The study examined the role of DNA as one of the most important scientific techniques that contributed to the activation of police work and the control of crimes and its perpetrators through the study of the analytical originality . In its first part, the researcher relied on trying to find a brief definition of the DNA, as well as its importance and characteristics.\nIn the second part the researcher discussed the legitimacy of the DNA after a doctrinal trend appeared to violate the rights of the individual. He stressed the need to establish legislative controls on this procedure, punish its abuse, and that it should not be allowed in all cases.\nAt the end the study concluded with the following recommendations: \n1.\tSupport the police equipment and laboratories with state-of-the-art DNA analysis devices.\n2.\tTo enact legislation that includes conditions for the use of DNA, ensuring that the results are not misused.\n3.\tThe independence of existing laboratories for DNA analysis should be strictly controlled.\nThis abstract translated by Dar AlMandumah Inc 2018. |
