| 520 | |f The phenomenon of violence is one of the problems related to health that threatens the individual and society at the same time. It is widespread in all areas of social, family and school life. At the beginning of the 1990s, the phenomenon of violence invaded the world of work and became a reality that workers live their daily life in the workplace.\nViolence at work, in particular, psychological abuse, is considered as one of the occupational and psychosocial risks to which workers in the labour organization are exposed. This behaviour is so widespread in the modern era that it has become similar to one of the serious diseases of the era. It threatens the safety of the workers on the one hand and the effectiveness of the organization on the other and leaves negative effects on the mental health of the worker, making him vulnerable to some mental disorders, the most famous of which are depression, anxiety, post-traumatic stress disorder and some neurological disorders. Due to the seriousness of this phenomenon, various countries of the world have sought to regulate it according to legal frameworks that penalize on exposing workers to psychological violence in their workplace. However, we do not find any legal provision in the Algerian law that punishes psychological violence at work, which causes Algerian workers to suffer in silence, which inevitably negatively affects their mental health.\nThis abstract translated by Dar AlMandumah Inc. 2018 | ||
| 520 | |a تعتبر ظاهر العنف احدى مشاكل الصحة التي تهدد الفرد والمجتمع في آن واحد وهي منتشرة في شتى مجالات الحياة سوءا الاجتماعية، الأسرية، المدرسية وفي مطلع التسعينان غزت ظاهرة العنف عالم الشغل وأصبحت واقع يعيشه العامل يوميا في محيط عمله.\n\tيعتبر العنف في العمل خاصة العنف النفسي، من بين الأخطار المهنية والنفسية الاجتماعية، الذي يتعرض إليه العامل في منظمة العمل، وهو سلوك واسع الانتشار في العصر الحديث إلى درجة أنه أصبح شبيه بإحدى أمراض العصر الخطيرة، حيث أنه يهدد سلامة العامل من جهة وفعالية المنظمة من جهة أخرى ويترك أثار سلبية على الصحة العقلية للعامل ما يجعله عرضة لبعض الاضطرابات العقلية اشهرها الاكتئاب، القلق اضطراب الضغط ما بعد الصدمة وبعض الاضطرابات العصبية، ونظرا لخطورة هذه الظاهرة سعت مختلف دول العالم إلى تنظيمها وفق أطر قانونية تعاقب على تعريض العاملين للعنف النفسي في مكان عملهم إلا أنه لا نجد في القانون الجزائري أي مادة قانونية تعاقب على العنف النفسي في العمل ما يجعل العامل الجزائري يعاني في صمت مما ينعكس لا محال سلبا على صحته العقلية. | ||
| 520 | |d Le phénomène de la violence est l’un des problèmes de santé qui menacent l’individu et la société, qui se répand dans différents domaines de la vie, sociale, familiale, scolaire.\nAu début des années quatre-vingts dix, La violence se répand sur les lieux de travail, en particulier la violence psychologique qui fait partie des risques professionnels et psychosociaux auxquels le travailleur est exposé dans l’organisation du travail il s’agit d’un comportement qui a envahi l’époque moderne et considéré comme l’une des graves maladies épidémiques contemporaines, Ce qui menace la sécurité du travailleur d'une part et l'efficacité de l'organisation d'autre part Il est la cause principale des effets négatifs sur la santé mentale du travailleur qui le rend vulnérable à certains troubles mentaux, notamment la dépression, l'anxiété et le trouble stress post-traumatique.\nEn raison de la gravité de ce phénomène, les différents pays du monde ont cherché à l’organiser selon des cadres juridiques qui pénalisent l’exposition des travailleurs à violence psychologique sur leur lieu de travail , Le droit algérien ne mentionne aucun article qui punit la violence psychologique au travail, et laisse les travailleurs algériens subir la souffrance en silence, ce qui se répercute négativement sur leur santé mentale. | ||
