The views of scattered and extinct schools of Islamic jurisprudence and its evidence on the important jurisprudential subjects, especially in our time, because of the disappearance and persistence of many of the doctrines of schools of Islamic jurisprudence that existed in previous eras, namely the era of the emergence of schools that appeared and were scattered in its time, therefore, the researcher wrote about it and named it (views of the scattered and extinct schools of Islamic jurisprudence and its evidence). As for the research divisions, the search included an abstract and two sections, preceded by an introduction and a preliminary note, and then the conclusion, sources, references and margins. The two sections were then divided into several parts. The first held the views of the doctrines of scattered and extinct schools of Islamic jurisprudence and its evidence. This topic was in three parts: the first one; the definition of worships (العبادات) in the language and its terminology, and it includes the views of scattered schools of Islamic jurisprudence and its evidences in prayer (الصلاة). And the second one was the views of the scattered schools of Islamic jurisprudence and its evidence in fasting (الصوم), and third one was the views of the scattered schools of Islamic jurisprudence and its evidences in alms in (الزكاة). While the second section came in the views of scattered schools of Islamic jurisprudence and its evidences in transactions. This section was divided in two parts, the first one; in the views of scattered schools of Islamic jurisprudence and its evidences in the sale of choice (khiyar al Majlis), and the second; in the views of scattered schools of Islamic jurisprudence and its evidences in the sale of absent objects. Then research came to an end and concluded with a conclusion in which it highlighted the main findings, and then a list of sources, references and margins, with a summary in English about the subject.\nThis abstract translated by Dar AlMandumah Inc 2018. الحمد لله رب العالمين، المتفضل علينا بالهداية والعناية والتمكين، والصلاة والسلام على المبعوث رحمة للعالمين، وعلى آله الطيبين الطاهرين، ثم الرضا والرضوان على أصحابه المنتجبين الأخيار.\nأما بعد... فيعد آراء المذاهب الفقهية المندثرة والمنقرضة وأدلتهم من الموضوعات الفقهية المهمة، ولاسيما في وقتنا الحاضر، بسب اندثار واضمرار الكثير من المذاهب الفقهية التي كانت موجودة في عصور سابقة، أي عصر ظهور المذاهب التي ظهرت واندثرت في زمانها، فلذلك قامت الباحثة بالكتابة فيه وتسميته (آراء المذاهب الفقهية المندثرة والمنقرضة وأدلتهم).\nأما أقسام البحث، فقد تضمن البحث على ملخص ومبحثين وسبقها مقدمة ونبذة تمهيدية. ومن ثم الخاتمة والمصادر والمراجع والهوامش، ومن ثم قسمت المبحثين إلى مطالب عدة، عقدت الأول؛ آراء المذاهب الفقهية المندثرة والمنقرضة وأدلتهم، كان هذا المبحث في ثلاث مطالب، الأول؛ تعريف العبادات في اللغة والاصطلاح، ويشمل آراء المذاهب الفقهية المندثرة وأدلتهم في الصلاة، والثاني؛ آراء المذاهب الفقهية المندثرة وأدلتهم في الصوم، والثالث؛ آراء المذاهب الفقهية المندثرة وأدلتهم في الزكاة. فيما جاء المبحث الثاني في آراء المذاهب الفقهية المندثرة وأدلتهم في المعاملات. وكان هذ المبحث في مطلبين، الأول؛ آراء المذاهب الفقهية المندثرة وأدلتهم في بيع الخيار (خيار المجلس)، والثاني؛ آراء المذاهب الفقهية المندثرة وأدلتهم في بيع الأعيان الغائبة. ثم ختمت البحث بخاتمة بينت فيها أبرز النتائج التي توصلت إليها، ومن ثم قائمة بالمصادر والمراجع والهوامش، مع خلاصة باللغة الإنكليزية للموضوع. |
